In Ordu, during the adaptation week attended by first-grade students, 7-year-old Miray Arslan, a first-grade student, lost her life after being hit by the school's physical education teacher, Banu Kaya. In her defense during the trial in which she was held in custody, Kaya made statements that were shocking. SHE WAS TAKEN FROM LIFE DURING ADAPTATION WEEKThe accident occurred on September 2, Monday, around 09:00, in the garden of Gazi Primary School located in the Saray neighborhood of the Altınordu district. The vehicle with license plate 52 BK 790, driven by physical education teacher Banu Kaya, hit first-grade student Miray Arslan, who was coming to school as part of the adaptation week. Miray Arslan was injured. Health teams were dispatched to the school upon the notification of the officials. Miray Arslan, the daughter of Eda and Yakup Arslan, could not be saved despite all the interventions at Ordu Training and Research Hospital, to which she was taken by ambulance. After the incident, teacher Kaya was arrested by the court after her procedures at the police station. TEACHER IS BEING TRIED IN CUSTODYThe trial of physical education and sports teacher Banu Kaya began today at the Ordu 5th Criminal Court of First Instance. Teacher Banu Kaya, who participated in the hearing as a defendant, connected via the Audio and Visual Information System (SEGBİS) from Efirli Type E Prison where she is held. Eda and Yakup Arslan, who participated in the hearing as complainants, along with their lawyer and the defendant's lawyer, were present at the hearing. THE VEHICLE'S SENSORS DID NOT GIVE A WARNINGIn her statement during the hearing, teacher Kaya said that she had been working as a teacher at the same school for 13 years. She stated that she went to school with her own vehicle on the day of the incident and that the sliding iron gate of the school was open. Kaya said, "There was a vehicle parked in the entrance area of the school. The entrance gate of the school was not an automatic gate. Since it was the first day of school, the sliding gate was fully open. When I entered through the gate, I did not receive any warning from the vehicle indicating that there was any danger around my vehicle. I passed through the gate and parked my vehicle. During all this time, my vehicle's windows were closed, I was using the air conditioning, and I was not listening to music. When I passed over the rails under the sliding door, the vehicle shook as if it was going over a bump. I parked my vehicle and when I looked at the entrance gate, I saw Miray lying on the ground. At the same time, I heard a scream. I said, 'Did I do it?' I fainted when I saw Miray, and they took me to the tea house at the entrance of the school. I do not remember the rest because I fainted," she said. EVERYONE PARKS THEIR VEHICLES IN THE SCHOOL GARDENDefendant teacher Banu Kaya stated that there was a problem with parking due to the location of the school, saying, "There are 25-26 teachers working at Gazi Primary School. The school principal, teachers, and all other staff working at the school park their vehicles in the school garden." SHE RAN OVER MY DAUGHTER AND CONTINUED ON HER WAYMother Eda Arslan, who claimed that teacher Banu Kaya entered the school garden at high speed, said, "The defendant entered the garden quickly and ran over my daughter. I did not clearly see the front wheel of the vehicle pass over my daughter, but as I approached the vehicle because it hit my daughter, I saw the rear wheels of the vehicle pass over my daughter. When I got close, I could not get very close. My daughter was on the ground covered in blood. The defendant continued on her way without even realizing that she hit my daughter and parked her vehicle in the area designated for service vehicles. I am complaining about the defendant," she said. I HEARD THE SOUND OF MIRAY'S BONES BREAKINGThe court also heard the testimony of Dilek Avcı, a parent who brought her child to school on the day of the incident. Witness Avcı stated that she heard the sound of Miray's bones breaking when the vehicle passed over her. She said, "Despite the defendant making a right turn from the ramp she exited quickly, I saw her maneuvering without reducing her speed. She hit Miray, who was in front of the door. The rear wheel passed over Miray. The defendant also passed quickly within the garden and parked in the area where the service vehicles were located. I also heard the sound of Miray's bones breaking when the defendant passed over her with her vehicle. After the defendant parked her vehicle, she came to Miray. Then the area became crowded, and they took the defendant into the school. I saw all of this clearly. While investigating who caused the accident, other parents said that the defendant had been warned for driving fast and aggressively in the school garden, but neither the defendant nor the school administration took these warnings into account," she said. BEING TRIED IN CUSTODYIn the prosecutor's opinion, it was stated that the defendant was primarily at fault and had committed the crime of 'causing death by conscious negligence', as she should have foreseen that small children could be present in the area, and due to the difference in elevation between the entrance of the garden and the area where the accident occurred, it was stated that she committed the crime of 'causing death by conscious negligence' and that the continuation of her detention should be decided. The hearing was adjourned upon the defendant's request for additional time.
