The indictment prepared regarding the incident in which Manisa Metropolitan Municipality Mayor Ferdi Zeyrek lost his life has been accepted. The expert report included in the indictment emphasized that the pool in the house was approved as an ornamental pool in the project, but a swimming pool was constructed instead. It was revealed that a water leak occurred while cleaning the bottom of the pool the day before the incident, and the person responsible for pool maintenance had warned that the motor might have burned out; however, this information was not communicated to Zeyrek.
In the expert report prepared for the indictment accepted by the Manisa 5th Heavy Penal Court regarding the death of Manisa Metropolitan Municipality Mayor Ferdi Zeyrek; it was determined that the pool at Zeyrek's house was approved as a decorative pool within the project, yet a swimming pool was constructed instead. It was noted in the indictment that a water leak occurred in the pool, which had undergone bottom cleaning a day before the incident, and Yalçın Ö. (55), who was responsible for the pool maintenance, warned that the motor might have burned and that no intervention should be made, but site security officer Ahmet S. (56) did not convey this situation to Ferdi Zeyrek due to the holiday rush.
TRAGEDY OCCURRED ON JUNE 6
On the evening of June 6, at his home in the Yunusemre district, Manisa Metropolitan Municipality Mayor Ferdi Zeyrek was electrocuted and passed away on June 9 at Manisa Celal Bayar University Hafsa Sultan Hospital, where he was receiving treatment. Zeyrek's funeral was held the next day in Manisa Republic Square and he was laid to rest. As part of the investigation initiated regarding Zeyrek's death, the water in the pool of the villa where the incident occurred was drained, and the surrounding area and the machine room were fenced off. The pool, which was later covered, was converted into a play area for Zeyrek's children.
3 SUSPECTS ARRESTED
As part of the investigation conducted by the Manisa Chief Public Prosecutor's Office, Ferdi Zeyrek's wife Nurcan and daughter Nehir Zeyrek provided statements as complainants. In the investigation, Z. M., who made the construction molds for Zeyrek's pool, M.Y.P., who was evaluated to have participated in the construction of the pool, and Naim B., who was alleged to have improperly installed the motor and electrical components in the energy room, were taken into custody, along with Halim İ., who was mentioned in the expert report for faulty installation. After their procedures at the police station, suspects Zafer M., Naim B., and Halim İ. were arrested for 'causing death by negligence.' M.Y.P. was released after his statement at the prosecutor's office.
5-PERSON COMMITTEE PREPARED A REPORT
As part of the investigation, a report prepared by a 5-person academic committee from Istanbul Technical University's (ITU) departments of mechanical, electrical-electronics, construction, and disaster management was completed on September 25. The report stated that the energy room of the pool where the incident occurred was not constructed in accordance with standards, that the motor and electrical components were improperly installed, and that there were other individuals responsible for the incident. The report emphasized that there were differences in fault situations and that third parties who could be primarily and secondarily at fault in the incident were identified. In this context, it was determined that 6 more individuals were at fault.
1 PERSON RELEASED ACCORDING TO THE REPORT
Moreover, according to the report; Naim B., who was detained as part of the investigation for allegedly improperly installing the motor and electrical systems in the pool's energy room, and Halim İ., who was alleged to have improperly reinstalled the pool motor after it had previously malfunctioned, were found to be primarily at fault. Zafer M., who was also arrested in the same case, was released as no fault could be attributed to him.
INDICTMENT AGAINST 10 PEOPLE
After the completion of the report, the indictment prepared by the Manisa Chief Public Prosecutor's Office was finalized. A total of 19 individuals were processed as part of the investigation, and a request for investigation permission was also made regarding Ömer T., who worked as a control officer in the building usage permit unit at Yunusemre Municipality, and Murat S., who worked as a technician in the same unit. Based on the evidence, statements, and expert reports collected during the investigation, an indictment was prepared against 10 individuals who were found to be primarily and secondarily at fault.
DECISION OF NON-PROSECUTION FOR 9 PEOPLE
In the indictment submitted to the Manisa 5th Heavy Penal Court; Naim B., who installed the electrical and motor systems of the pool, Halim İ., who repaired the pool motor when it broke down, site security officer Ahmet S., Yalçın Ö., who was responsible for pool maintenance and occasionally dealt with problems in the machine room, Hakan A., the owner of the motor rewinding company, Murat E., an employee of the electricity distribution company, and engineers Rezan A., Hilmi Ş., and Mustafa Ç., who were inspectors at the building inspection company, as well as Metin G., a representative of the contracting company, were all charged with 'causing the death of one person and the injury of another by negligence' against both Ferdi Zeyrek and his wife Nurcan Zeyrek, who was injured in the arm due to electric shock during the intervention, with a request for prison sentences ranging from 2 to 15 years. Additionally, a decision of non-prosecution was made for suspects A.A., Zafer M., M.Y.P., S.P., Ş.İ.T., M.S., E.T., H.S., and H.A., who could not be attributed any fault during the investigation. The trial of 10 defendants, 2 of whom are in custody, will begin on Friday, December 5, as part of the indictment accepted by the Manisa 5th Heavy Penal Court.
APPROVED AS A DECORATIVE POOL
The expert report included in the indictment revealed that the project for the swimming pool in front of the house was hand-drawn by architect Ferdi Zeyrek on A4 paper, and it was approved as a decorative pool. Furthermore, it was determined that the private building inspection company responsible for the supervision of the construction had given approval that the pool installation was in accordance with regulations, and a compliance report regarding the electrical project was also issued. Additionally, it was understood that the report created as a result of the inspection conducted by the electricity distribution company stated that there were no deficiencies or irregularities in the electrical installation. The indictment noted that the ground fault relay in the pool and energy room was faulty and that other ground fault relays at the entrances of independent apartments had been removed later.
THE SITUATION WAS NOT REPORTED TO FERDI ZEYREK
The report also included that the pool motor had malfunctioned previously and that its rewinding maintenance had been performed. It was stated in the report that a salt device was installed in the pool 5 days before the incident. A water leak occurred in the pool, which had undergone bottom cleaning a day before the incident, and it was reported that the water was drained by site security officer Ahmet S. using a submersible pump, during which the circuit breaker in the electrical panel repeatedly tripped. It was noted that the situation was reported to Yalçın Ö., who was responsible for pool maintenance, and that a warning was given that the motor might have burned and that no intervention should be made, but Ahmet S. did not convey this situation to Ferdi Zeyrek due to the holiday rush. Additionally, the report stated that Zeyrek, who entered the pool with his twins on the day of the incident, was disturbed by the murky water and, after changing his clothes, was electrocuted while entering the machine room, resulting in his death.
