A woman who was sentenced to 5 years in prison for allegedly feeding human feces to her 8-year-old stepdaughter has now come into the spotlight again due to the death of her 6-year-old stepson, who fell from a bunk bed. She will be retried for causing death or injury by negligence.
Fatma Y., who was sentenced to 5 years in prison for feeding her stepdaughter B.Y. (8) human feces, will be retried in connection with the death of her stepson R.Y. (6), who fell from a bunk bed.
Following the investigation into the death of her stepson R.Y., who fell from a bunk bed on August 15, 2020, an indictment was prepared against Fatma Y. for the crime of 'Causing death or injury by negligence.' After the indictment was accepted by the Kayseri 14th Criminal Court of First Instance, Fatma Y. was tried and sentenced to 1 year and 8 months in prison on September 14, 2021. The judge decided to suspend the announcement of the sentence for 5 years due to the defendant's lack of prior convictions.
LAWSUIT FOR ABUSE
On the other hand, Fatma Y.'s husband C.Y. became suspicious of the behavior of his wife and daughter B.Y. after the death of their son and placed a voice recording device in the house. During the period from August 15, 2020, to July 10, 2022, it was revealed through the recording device that Fatma Y. verbally abused her stepdaughter B.Y. on different dates, tortured her, and fed her human feces. Following C.Y.'s complaint, a lawsuit was filed against Fatma Y. for the crime of 'Abuse.'
SENTENCED TO 5 YEARS IN PRISON
During the verdict hearing of the case held at the Kayseri 16th Criminal Court of First Instance, the defendant Fatma Y., the victim B.Y., and the victim's father C.Y.'s lawyer Mustafa Avşar were present. The judge sentenced Fatma Y. to 5 years in prison for the crime of 'Abuse against a child.' The judge did not apply a 'good behavior' reduction for the defendant, considering her previous conviction, the seriousness and value of the crime, and the lack of a positive opinion regarding the defendant's genuine remorse and assurance that she would not commit another crime.
APPEAL DECISION UPHELD
The victim B.Y.'s lawyer Mustafa Avşar appealed the decision, arguing that the defendant should receive the maximum sentence, and brought the case to the Kayseri Regional Court of Appeal. The 1st Criminal Chamber, which reviewed the case, decided to reject the appeal requests of the victim's lawyer Avşar on the merits. The Criminal Chamber stated that there was no legal violation regarding the procedure and substance of the local court's decision, that there were no deficiencies in the evidence and proceedings, and that the assessment regarding proof was appropriate, thus deciding to reject the applications on the merits. It was noted that the decision was made unanimously.
SUSPENDED SENTENCE LIFTED
Following the conclusion of the abuse case, the previously suspended sentence of 1 year and 8 months for Fatma Y. was lifted due to her committing a crime during the 5-year probation period. Accordingly, Fatma Y. will be retried at the Kayseri 14th Criminal Court of First Instance for the crime of 'Causing death or injury by negligence.'
