In the case regarding the shooting of social media influencer Banu Parlak's beauty center, the prosecution appealed against the acquittal of the defendants, including Dilan, Engin, and Sezgin Polat.

The Küçükçekmece Chief Public Prosecutor's Office reminded that a conviction decision should have been made regarding the defendants Dilan, Engin, and Sezgin Polat for "instigating the crime of threatening with a weapon together with multiple persons," instead of an acquittal decision, in the objection petition submitted to the Küçükçekmece 3rd Criminal Court of First Instance to be sent to the Istanbul Regional Court of Appeal.



In the petition, which stated that the acquittal decision was contrary to procedure and law, it was reported that there was animosity between the complainant Banu Parlak and the defendant Dilan Polat before the incident, and that the complainant submitted messages indicating she was threatened to the case file. Due to this animosity, it was noted that the defendants Dilan, Engin, and Sezgin Polat contacted Beratcan Gökdemir and his brother Batın Can Gökdemir, who are fugitives and known as the leaders of the organized crime group referred to as the "Dalton gang," to organize an armed attack on the complainant's workplace.



The petition stated that the leader Beratcan Gökdemir gave instructions for action to the defendants Batuhan İnci, Yunus Emre Yıldız, Nizamettin Bilgili, Onur Abiç, and İsmail Emre Arifoğlu, who were waiting for instructions ready for action in a safe house belonging to the "Dalton" group, and also informed them of the address where they would receive the motorcycle and weapon to be used in the action, as well as the location of the business named "Banu Parlak Beauty Center."



It was emphasized in the petition that the defendants who carried out the attack did not know the complainant and had no animosity with her, and after the defendant Dilan Polat threatened the complainant, other defendants who received instructions from the organized crime group carried out two separate armed attacks on the same day in a coordinated manner against the complainant's workplace.

THREAT SHARING, STATEMENTS, REPORTS...

In the petition, it was noted that "the complainant's statement, witness testimony, the threatening social media posts of the defendant Dilan Polat directed at the victim Banu Parlak, examinations conducted on digital materials, confessions from some of the defendants, the crime scene investigation report, forensic expert report, police records, and the case file indicate that the defendants Engin, Dilan, and Sezgin Polat committed the crime of 'threatening with a weapon together with multiple persons' by instigating the organized crime group known as the 'Dalton Gang' in a coordinated manner."



The petition reminded that the complainant Banu Parlak withdrew her complaint against the defendants, but stated that the crime of threatening with a weapon is not subject to complaint, and therefore, it was contrary to procedure and law to decide on their acquittal instead of punishing the defendants.



It was also noted in the petition that it was contrary to procedure and law to acquit the defendant Onur Abiç of the charges of "membership in an organization established for committing crimes," "threatening with a weapon together with multiple persons," and "violating the Firearms Law No. 6136," and to acquit the defendant İsmail Emre Arifoğlu of the charge of "threatening with a weapon together with multiple persons."



LOW SENTENCES WERE ALSO CHALLENGED

In the petition, it was stated that the defendants Batuhan İnci, Nizamettin Bilgili, Yunus Emre Yıldız, and İsmail Emre Arifoğlu were sentenced to the minimum penalty for the charges of "membership in an organization established for committing crimes" and "violating the Firearms Law No. 6136," and it was argued that considering the manner of committing the crime, the place and time it was committed, the importance of the subject of the crime, the defendants' intentions, the violation of the qualified circumstances stated in the law, and the actions taken, the sentences should be increased beyond the minimum penalty for these crimes.



WHAT HAPPENED?

The Küçükçekmece Chief Public Prosecutor's Office had filed a lawsuit against Dilan, Engin, and Sezgin Polat, among 11 defendants, on the grounds that Dilan Polat shot at Banu Parlak's workplace.



The Küçükçekmece 3rd Criminal Court of First Instance acquitted Dilan, Engin, and Sezgin Polat, who were tried without detention, of "instigating the crime of threatening with a weapon together with multiple persons," and decided to dismiss the charge of "instigating damage to property" on the grounds that it was subject to complaint.



The court, which ruled for the acquittal of the defendant Onur Abiç, sentenced detained defendants Batuhan İnci and Nizamettin Bilgili to 5 years and 6 months each, and Yunus Emre Yıldız and İsmail Emre Arifoğlu to 4 years and 7 months each for the charges of "membership in an organization" and "threatening with a weapon together with multiple persons."



The court also decided to release 5 detained defendants and separated the files of the fugitive defendants Barış Boyun, Beratcan, and Batın Can Gökdemir.
