In the case regarding the death of Mattia Ahmet Minguzzi, who was stabbed to death in Kadıköy, the sentences of 24 years in prison given to the defendants B.B. and U.B. at the maximum limit, as well as the acquittal decisions for M.A.D. and A.Ö., were upheld by the Court of Appeals as being in accordance with the law.

In the case regarding the death of Mattia Ahmet Minguzzi (15), who was attacked with a knife at a flea market in Kadıköy, B.B. and U.B. were sentenced to 24 years in prison each without any discount, while M.A.D. and A.Ö. were acquitted. The sentences of the defendants were upheld by the 1st Criminal Chamber of the Istanbul Regional Court of Justice.

APPEAL COURT UPHELD SENTENCES

The 1st Criminal Chamber of the Istanbul Regional Court of Justice (appeal) completed its review of the 24-year prison sentences given to detained B.B. and U.B. by the Anadolu 2nd Children's Heavy Criminal Court for the crime of "intentional killing of a child," as well as the acquittal decision regarding other defendants M.A.D. and A.Ö. for "aiding in the intentional killing of a child."

According to the reviewed file, the chamber ruled that there was no inaccuracy in the local court's decision and found the reasons presented by the representative of the Family and Social Services Ministry and the participants Yasemin Akıncılar Minguzzi and Andrea Minguzzi regarding the need for the children to be punished at the highest limit for multiple qualified offenses to be unfounded.

The chamber, not finding the other appeal reasons valid, deemed the 24-year prison sentences given to B.B. and U.B. to be in accordance with the law. It decided to reject the appeal applications on their merits separately.

The chamber, which found the acquittal decisions regarding M.A.D. and A.Ö. to be legally appropriate, also rejected the appeal reasons regarding the need for them to be punished at the upper limit for the crime of "qualified intentional killing" as unfounded.

FINAL DECISION WITH THE SUPREME COURT

The chamber ruled that the appeal application was rejected on its merits, with the right to appeal to the Supreme Court open.

The final decision regarding the case will be made by the Supreme Court.

WHAT HAPPENED?

In the indictment prepared by the Anadolu Chief Public Prosecutor's Office, it was stated that on January 24, Mattia Ahmet Minguzzi went to the historical Tuesday market in Kadıköy Hasanpaşa with his friends to buy skateboarding equipment, where he encountered U.B. (15) and B.B. (15), and after a conversation, B.B. pushed Minguzzi.

The indictment mentioned that B.B. punched Minguzzi, who continued to walk around, and that the suspect injured Minguzzi in different parts of his body with a knife in his hand.

It was also stated in the indictment that U.B. kicked Minguzzi, who had fallen to the ground, and that after the intervention of nearby citizens, U.B. and B.B. fled, while Minguzzi, who was treated in the hospital after the incident, died on February 9, 17 days later.

According to the autopsy report obtained from the Forensic Medicine Institution, it was recorded that Minguzzi had three sharp force injuries on his body and a penetrating injury to his chest, and the cause of death was due to internal organ injuries resulting from a sharp force attack.

The indictment noted that U.B. kicked Minguzzi, while B.B. stabbed him multiple times with a knife taken from the counter, and it was requested that both juveniles, who were caught and arrested after the incident, be sentenced to imprisonment of 18 to 24 years for the crime of "intentional killing of a child."

As part of the investigation conducted by the Anadolu Chief Public Prosecutor's Office, an indictment was prepared with a request for consolidation against M.A.D. and A.Ö., who were determined to have acted with B.B. and U.B. on the day of the incident, for "aiding in the intentional killing of a child," seeking imprisonment of 15 to 20 years.

On October 21, the Anadolu 2nd Children's Heavy Criminal Court concluded the case by sentencing the juveniles B.B. and U.B. to 24 years in prison for the crime of "intentional killing of a child." The panel did not apply any discount in the sentence and ruled for the continuation of the detention of B.B. and U.B.

The panel decided to acquit M.A.D. and A.Ö. of the charge of "aiding in the intentional killing of a child" and released them. The decision was appealed.
