In the decision hearing on May 30 at the Diyarbakır 17th Criminal Court of First Instance, the penalties regarding the defendants Birsen Güran, Fuat Güran, Maşallah Güran, Salim Güran's worker Mehmet Selim Atasoy, Mehmet Şevket Kaya, Muhammed Kaya, Şeyma Kaya, Hediye Güran, İbrahim Halil Güran, Barış Güran, Kurtuluş Güran, and Ömer Faruk Güran, as well as the minors involved in the crime R.A. (16), M.G. (16), and İ.K. (17) were evaluated based on the applications made by the defendants' lawyers, the Ministry of Family and Social Services, and the lawyers of the Association for Struggle Against Child Abuse (UCİM).
PENALTIES WERE OVERTURNED
Evaluating the requests, the Diyarbakır Regional Court of Appeals 7th Criminal Chamber decided to reject the appeals of the Ministry of Family and Social Services and the lawyers of the Association for Struggle Against Child Abuse (UCİM) on the grounds that they did not have the status of "directly harmed by the crime" and that the law did not grant them the "right to participate directly."
The decision noted that there is a right to appeal to the Diyarbakır Regional Court of Appeals 8th Criminal Chamber. It was stated that there is a connection under Article 8/2 of the Criminal Procedure Code (CMK) between the ongoing trial regarding the crime of "aiding the offender" concerning the 12 defendants subject to the appeal and the trial file regarding the murder of Narin Güran, which is currently at the Supreme Court for appeal.
DECISION WAS MADE UNANIMOUSLY
The decision recorded the following: "In light of the absolute effect of the outcome of the trial regarding the preliminary crime on the trial for the crime of 'aiding the offender,' it is necessary to make a decision based on the outcome of the trial file regarding the murder of the victim Narin Güran, which is currently at the Supreme Court for appeal, to consider the outcome of the trial file regarding the preliminary crime as a pending issue, and if a reversal decision is made as a result of the appeal examination regarding the preliminary crime, both documents should be combined at the high competent first instance court and decided based on the evidence collected as a whole. It has been seen that making a decision with incomplete investigation in writing is unlawful. Since the grounds for appeal are found to be valid, it has been unanimously decided to overturn the judgments and decisions separately in accordance with Articles 280/1 and 289/1 of the CMK."
WHAT HAPPENED?
In the decision hearing held on May 30 at the Diyarbakır 17th Criminal Court of First Instance, it was decided to continue the detention of the arrested defendants Birsen, Fuat, and Maşallah Güran, who were tried for the crime of "aiding the offender," and they were sentenced to 3 years and 6 months in prison.
The court, which sentenced the detained defendants Salim Güran's worker Mehmet Selim Atasoy, Mehmet Şevket Kaya, and Muhammed Kaya to 3 years in prison, decided to release the defendants separately, considering the nature and characteristics of the crime charged against them, the current state of evidence, the amount of the sentence imposed, and the time spent in detention.
The court sentenced the non-detained defendants Hediye Güran to 3 years and 6 months, and Şeyma Kaya, İbrahim Halil Güran, Barış Güran, Kurtuluş Güran, and Ömer Faruk Güran to 3 years in prison, while it sentenced the minors involved in the crime R.A. (16) to 1 year and 3 months, and M.G. (16) and İ.K. (17) to 1 year and 8 months in prison, ruling that the announcement of the judgment be postponed.
In the case regarding the murder of Narin Güran, the detained defendants mother Yüksel, brother Enes, and uncle Salim Güran were sentenced to aggravated life imprisonment for "intentional murder of a child in participation," while Nevzat Bahtiyar was sentenced to 4 years and 6 months in prison for "destroying, concealing, or altering evidence of a crime." The Diyarbakır Regional Court of Appeals 1st Criminal Chamber found the judgments given by the first instance court to be lawful.
The Chief Public Prosecutor's Office of the Supreme Court requested the approval of the aggravated life sentences given to mother Yüksel, brother Enes, and uncle Salim Güran, as well as the 4 years and 6 months prison sentence given to Nevzat Bahtiyar in the Narin Güran murder case.
The defendants Birsen, Fuat, and Maşallah Güran, whose release was decided, were released from the prison they were in yesterday.
