Murat C., a businessman in Ankara, filed for divorce, claiming that his banker wife Esra C., whom he married in 2020 and was married to for 4 years, disrespected his family, called him at least 10 times a day for 10 minutes each time, insulted him, and hired a detective to follow him, demanding 300,000 lira in total, consisting of 150,000 lira in material damages and 150,000 lira in moral damages. In the case opened at the Ankara 4th Family Court, Esra C. claimed that her husband's allegations were not true and that he failed to fulfill his obligations arising from the marriage, requesting the dismissal of the case. The court decided on the couple's divorce and ruled that Esra C. was heavily at fault in the events that caused the fundamental disruption of the marriage, ordering her to pay 300,000 lira in damages. Esra C. appealed the decision and took the case to the appellate court. The Ankara Regional Court of Justice 2nd Civil Chamber also ruled to reject Esra C.'s appeal. The court accepted Murat C.'s request for divorce and found the local court's decision to be in accordance with the law. The Supreme Court 2nd Civil Chamber upheld the decision, ruling that the defendant woman's appeal was unfounded and that the court's decision was lawful.
'THE DECISION HAS BECOME FINAL'
Murat C.'s lawyer, Senem Yılmazel, stated that the defendant woman applied psychological violence to her client, saying, "She is seriously jealous and puts pressure on him, insults and curses. She called my client 10 times a day. She wanted to constantly check his phone. She hired a detective. For about 2-3 months, the detective followed my client. We filed for divorce with a claim for material and moral damages. At the end of the trial, it was decided to award 150,000 lira in material damages and 150,000 lira in moral damages in favor of my client. Since my client's personal rights were violated and their interests were harmed due to the divorce, damages were awarded in favor of my client. Later, this went through the appellate review. The decision has become final after passing through the Supreme Court," she said.
'EXCESSIVE JEALOUSY IS A REASON FOR DIVORCE'
Lawyer Yılmazel stated that they proved the detective's follow-up with a witness, saying, "Someone was constantly following my client. He suspected, along with his friend, 'Why is someone following me?' When they later asked, he said he was a detective. He even asked for more money from him, saying, 'Let me tell you the truth.' My client did not accept this; he said, 'I have no infidelity, there is no situation.' We wanted this person to be heard as a witness, but he was not called as a witness because he did not want to testify. My client's friend was heard as a witness. This way, it was proven. Besides that, with the HTS records, it was even shown that he called 10 times within an hour. He reports that he had a lot of problems when he was in a meeting. When the phone records came, it was also proven that he called very frequently and a lot. Excessive jealousy is a reason for divorce. For this reason, couples should be careful about this, and they should have trust and respect for each other," she said.
