The suspect, who killed his brother by cutting his throat and genitals, claiming that he was sexually abused in Karamürsel, defended himself by saying, "I saw my brother committing the same acts on someone else when I was at that age. This traumatized me. The incident occurred because of this." The court, finding this defense insufficient, decided to punish the defendant with aggravated life imprisonment.
In Karamürsel district of Kocaeli, Emre Torun (31) who cut his throat and genitals by claiming that he was sexually abused by his brother Murat Can Torun (32) when he was a child, was sentenced to aggravated life imprisonment without parole. The court unanimously rejected the application of unjust provocation.
SEXUAL ABUSE ALLEGATION
According to the allegations in the incident that took place on April 22 last year in the 4th of July Neighborhood 204th Street in Karamürsel district; Emre Torun told his father that his brother Murat Can Torun sexually abused him when he was a child. The father wanted to confront his son with what Emre Torun told him, but Emre Torun did not come home that day. The next morning, Emre Torun went home and stabbed his brother Murat Can Torun.
STOPPED BY THE POLICE
After the incident, Emre Torun, who went out on the street with a knife, was stopped by a police team about 1 kilometer away. When Torun told the police team that he killed his brother, the police and emergency medical team were dispatched to the house. The teams that arrived at the address encountered the lifeless body of Murat Can Torun. Emre Torun was arrested and sent to prison, and a lawsuit was filed against him with the demand for aggravated life imprisonment for "deliberately killing with monstrous feeling against the upper lineage".
'HE WOULD HAVE COMMITTED THE ACT IF I HADN'T RAISED MY VOICE'
At the final hearing held today at Kocaeli 1st Heavy Penal Court, the defendant Emre Torun and his lawyers were present. When the presiding judge asked about the sexual abuse, the defendant Torun said, "When I was 6-7 years old, I was sexually abused by my brother while we were at home. He took off my underwear. If I hadn't raised my voice, he would have committed the act. When I was that age, I saw my brother doing the same acts to someone else. This traumatized me. The incident happened because of this." Torun's lawyer stated that the incident occurred under unjust provocation.
NO REDUCTION APPLIED
When asked for his final words, the defendant said, "It is up to the court to decide." The court ruled that there was no place for punishment for the crime of "deliberately killing with monstrous feeling against the upper lineage" and sentenced him to aggravated life imprisonment for the crime of "killing against the upper lineage". The court, by majority vote, ruled that unjust provocation was not applied, and no reduction was applied to the sentence due to the defendant's lack of remorse.
