The incident occurred in April in Tepeköy, a district of Gökçebey. H.B. filed a complaint, claiming that her ex-husband Cengiz B., despite having a restraining order against him, came to the house, covered her mouth with a bathrobe belt, threatened her with a knife to her throat, and sexually assaulted her. As part of the investigation, Cengiz B. was detained by the gendarmerie. In his first statement at the gendarmerie, Cengiz B. denied the allegations, but he was arrested due to DNA found on a knife in the house and scratch marks on H.B.'s body. A case was opened against Cengiz B. for 'Violation of residence immunity' and 'Qualified sexual assault'. In the first hearing held at the Zonguldak 1st Heavy Penal Court, the detained defendant Cengiz B. was present with his lawyer, while no one attended on behalf of the complainant. "MY WIFE ATTACKED ME WHEN SHE FOUND THE MONEY I GAVE HER WAS TOO LITTLE"Cengiz B. stated in his defense, "I went to my wife's house 10 days before the complaint, we talked a bit and had consensual intercourse. I was financially supporting my wife, paying her bills. That day, I gave her money and left the house. At the time of the incident, she sent a message through my son and called me. I went home at night, and she was talking on the phone. I waited for her to hang up. When I showed myself through the window, she opened the door and let me in. We talked for half an hour, and then I had sexual intercourse with my wife. After that, we talked for another half hour. My wife started asking me for money. I told her I didn't have much money, just 1000 lira. I gave her 400 lira. She returned the money, saying, 'This money is too little.' When my wife found the money insufficient, she started to attack me. In fact, during the argument, she raised her voice and hit me. I thought the children and neighbors would be disturbed, so I left the house. The next day, I learned that she had filed a complaint against me. I never thought she would complain about me," he said. "THE KNIFE WAS MY FRUIT KNIFE BEFORE THE DIVORCE"Cengiz B., who also mentioned that there was a restraining order against him, said he approached his 15-year-old daughter because he saw her on a motorcycle with a 14-year-old boy, thus violating the order and getting reported. He later explained that he had gone home after talking to his wife and had intercourse. When asked about the DNA found on the knife that he allegedly held to his ex-wife's neck, Cengiz B. said, "The knife was my fruit knife before the divorce. It was in the kitchen cabinet. I hadn't taken this knife after the divorce. It was just there in the house. I do not accept the allegation that I forced her into intercourse by holding a knife. She is a 37-year-old woman. There is also an application on her phone due to the restraining order. I stayed in that house for 1.5 hours. If something had happened, she could have pressed the button and called for help immediately. If I had forced her into sexual intercourse that night, she could have entered the application on her phone and called for help," he stated. Cengiz B. stated that they had sexual intercourse 10 times after the divorce, the last time being 10 days before the complaint, saying, "We had sexual intercourse on the day of the incident, but I don't know why my wife didn't file a complaint 10 days ago. In fact, on the day of the incident, before she filed a complaint, she called her sister, and I suspect that my wife set me up that day," he said. 'I HAD REPORTED MY MOTHER-IN-LAW'
When asked why he thought a setup was being made, Cengiz B. stated that they had a discussion after his mother-in-law said she would report that she was receiving a pension from her deceased father after his mother-in-law and father-in-law divorced amicably. Cengiz B. expressed that his wife divorced him under the influence of his mother-in-law, saying, "I had reported my mother-in-law. She wasn't talking to me. After my wife went to her mother-in-law's house, she decided to divorce me. Normally, there was no fight or noise between my wife and me. We divorced because my wife wanted to separate. In fact, we had stayed in the same house for 5 days after the divorce, but then she kicked me out," he said. DECISION TO CONTINUE THE DETENTIONThe defendant's lawyer stated that H.B.'s DNA was not found on the bathrobe belt that was allegedly tied around her mouth, and an unidentified DNA was found on the knife; he requested that the DNA deficiency be addressed and that an inspection be conducted to determine whether it was possible to forcibly enter the house. Additionally, the lawyer requested the release of his client due to inconsistencies in H.B.'s statement. The court stated that it had been determined during the investigation that there were no signs of forced entry on the doors and windows and decided to reject the requests for inspection and examination of the knife. The prosecutor, presenting his opinion, requested that the defendant be sentenced to up to 18 years in prison for 'Sexual assault against his ex-wife' and up to 2 years for 'Violation of residence immunity'. The court granted the defendant's lawyer time to prepare a defense and postponed the hearing while deciding to continue Cengiz B.'s detention.
