A lawsuit has been filed against 10 municipal employees regarding the Fazilet Apartment, where 19 people died in the Kahramanmaraş earthquake. The defendants are facing prison sentences of up to 22 years and 6 months each.

In the case regarding the deaths of 19 people in the Fazilet Apartment Block A, which collapsed during the earthquakes that occurred in Kahramanmaraş on February 6, 2023, three suspects are being tried without detention, and a lawsuit has been filed against 10 municipal personnel for "causing the death and injury of multiple people through conscious negligence," with a request for up to 22 years and 6 months in prison.



In the investigation conducted by the Kahramanmaraş Chief Public Prosecutor's Office Earthquake Crimes Investigation Bureau, it was determined that there was negligence on the part of the municipal personnel involved in the construction and renovation processes of the building.



The prepared indictment was accepted by the Kahramanmaraş 4th Heavy Criminal Court. The indictment states that the suspects involved in the process of issuing the building permit and occupancy permit documents acted contrary to the regulations during the project and supervision processes, and that the suspects had negligence in their duties.



LAWSUIT AGAINST 10 MUNICIPAL PERSONNEL



The indictment states that the then Deputy Mayor of Kahramanmaraş, C.T., and the then Director of Zoning Affairs, M.H., approved the structural static project, but allowed the building permit despite the project being contrary to the regulations.



It is reported in the indictment that the architects of the Kahramanmaraş Municipality at the time, H.M.G, M.S, M.D., and H.Ç., prepared the occupancy permit documents, and architect V. Ç. approved the building permit.



It is stated in the indictment that M.G., who served as the deputy mayor at the time, and Land Survey Engineer Z.A.Ş. also prepared the occupancy permit documents while the building was under construction, and F. Y., who worked in the Zoning Affairs Directorate of the Kahramanmaraş Municipality at the time, checked the building foundation visa process.



REQUEST FOR UP TO 22 YEARS AND 6 MONTHS IN PRISON



In the indictment, it was requested that the defendants be sentenced to up to 22 years and 6 months in prison for the crime of "causing the death and injury of multiple people through conscious negligence" under Articles 85/2 and 22/3 of the Turkish Penal Code.



The trial of the defendants will begin on September 19, 2025, at the Kahramanmaraş 4th Heavy Criminal Court.



Additionally, the indictment requested that individuals performing public duties be banned from practicing their profession due to behaviors contrary to the obligation of care and diligence while performing their duties.



19 PEOPLE HAD LOST THEIR LIVES



As a result of the collapse of Fazilet Apartment Block A during the earthquakes that occurred in Kahramanmaraş on February 6, 2023, 19 people lost their lives.
