In the case of the woman who died due to "wrong blood transfusion" at a hospital in Kahramanmaraş where she went for flu complaints, the court ruled that the Ministry of Health must pay the family 240,000 TL in moral damages. Additionally, the nurse who administered the wrong blood was sentenced to 3 years and 4 months in prison and banned from the profession for 1 year and 8 months.
Gülseren Alkaya, a 67-year-old woman who was hospitalized at Elbistan State Hospital due to health issues on February 27, 2020, has passed away.
HOSPITAL SAID 'HEART ATTACK', POLICE REPORT CHANGED EVERYTHING
According to allegations, the hospital informed the family that the cause of death was a heart attack; however, someone from the hospital called the police and reported, 'The woman was given the wrong blood, and that is why she died. The incident is being covered up.' Following this, an investigation was initiated, revealing that Gülseren Alkaya, who has blood type 0 Rh (+), was given A Rh (+) blood by nurse Abdullah Ö., which led to her death.
NURSE SENTENCED TO PRISON
As a result, a case was filed against Abdullah Ö. at Elbistan 4th Criminal Court for 'causing death by negligence' with a request for up to 15 years in prison. At the end of the trial, the court sentenced Abdullah Ö. to 3 years and 4 months in prison and banned him from the profession for 1 year and 3 months. The nurse appealed the decision. The Gaziantep Regional Court of Appeals 16th Criminal Chamber rejected the appeal, upholding the local court's prison sentence while increasing the professional ban to 1 year and 8 months.
MINISTRY OF HEALTH TO PAY COMPENSATION
Gülseren Alkaya's children filed a lawsuit for material and moral compensation at Kahramanmaraş 1st Administrative Court, claiming that the administration was also at fault in the incident. The court sent the file to an expert. After the expert's report was prepared, the court rejected the plaintiffs' request for material compensation and ordered the Ministry of Health to pay a total of 240,000 lira in moral compensation, 40,000 lira for each plaintiff.

Speaking after the decision, Gülseren Alkaya's son, Mehmet Akif Alkaya, stated that he took his mother to the hospital with flu complaints and received her body while waiting for her discharge. Alkaya said, "My mother had caught a cold, I took her to Elbistan State Hospital. They did tests. They said they needed to give her a unit of blood and that she would be discharged in the afternoon. When I went in the afternoon, they told me my mother had passed away. I went to the village to prepare for the funeral. In the evening, the hospital director called me and said an autopsy would be performed. I returned to Elbistan State Hospital, and the autopsy was done. I asked the director and the prosecutor why an autopsy was being performed, and they told me, 'this is the procedure.' Meanwhile, someone from the hospital called the police saying, 'I cannot live with a guilty conscience; the patient was given the wrong blood.' Meanwhile, the hospital had reported that my mother had a heart attack. They have put a price of 240,000 TL on a human life just for my mother," he said.
