S.Y., who works as a medical secretary at a private hospital in Polatlı, Ankara, filed a criminal complaint alleging that Ear, Nose, and Throat Specialist Dr. S.F.H. sexually assaulted her verbally and physically.
The doctor S.F.H., who was detained as part of the prosecutor's investigation, was released under judicial control by the duty magistrate, who was requested to be arrested. At the end of the investigation, an indictment was prepared against S.F.H. for the crime of 'sexual assault by harassment' with a request for up to 5 years in prison, and a lawsuit was filed. The indictment stated that Dr. S.F.H. kissed the medical secretary S.Y. on the cheek when no patients were present in the clinic room, and then hugged and touched her.
"MY CLIENT WILL WORK ABROAD"
The defendant, who has a travel ban as a judicial control measure, has started to be tried without detention at the Polatlı Criminal Court. In the hearing, the defendant doctor and the victim secretary, along with their lawyers, were present. The defendant doctor S.F.H. denied the allegations in his defense, claiming that the medical secretary was not doing her job properly, and that she made false accusations due to his reprimanding her. The defendant's lawyer also asked why the complainant did not react at that moment. The defendant's lawyer requested the removal of the judicial control measure, stating that his client would work as a doctor abroad. The complainant S.Y. stated that she was a complainant. The court panel decided to continue the defendant's travel ban as a judicial control measure and postponed the hearing for the completion of deficiencies.
"WE WERE LEFT IN ASTONISHMENT"
S.Y.'s lawyer Meltem Banko reacted to the doctor's request to work abroad, saying, "In the defenses and final requests of the defendant's lawyer, there were statements that the doctor would work abroad, and therefore the judicial control decision should be lifted; we were, of course, left in shock. How can a doctor facing such a serious crime, despite all witness statements and my client's statements, come before us with a statement like 'let's lift the judicial control' and say that he will go abroad to work as a doctor? We were honestly astonished. My client's psychology is very bad, and she rightfully terminated her employment contract. She stated that she never wants to work at that hospital again and does not even want to live in the Polatlı district. We are in a very serious situation. It is absolutely unacceptable for a person, due to being a doctor, to misuse their influence and approach a young girl working under their command for sexual purposes against her will and to engage in such actions. We trust the great Turkish justice in this matter and will do everything we can to ensure that the defendant receives the heaviest punishment."
