An indictment has been prepared regarding the incident in Yalova where Muhammet Baca and his 14-month-old baby İkra were assaulted. A prison sentence of 12 to 36 years is sought for the detained Şener Ergin on the charge of "intentional injury." The child's scooter, which the suspect hit Baca with, was considered a weapon.
The Baca family, who moved to a house they bought about a year ago in the Esenköy district of Çınarcık, Yalova, has reportedly been in constant disputes with the Ergin family living in the building due to noise, leading to animosity between the two families. According to the allegation; on February 20, while Muhammet Baca (34) was returning home, he encountered his neighbor Servet Ergin near the building. Muhammet Baca claimed that Servet Ergin said to him, "What are you looking at, man," and reported the incident to the gendarmerie. Baca explained the situation to the gendarmerie teams that arrived at the address. When his 14-month-old daughter İkra and his wife also came to the door, Muhammet Baca was attacked with a stick by Ergin's brother, Şener Ergin, while holding his daughter in his arms.
GENDARMERIE STRUGGLED TO SEPARATE THE FIGHT
Baca and his daughter İkra, whom he was holding, were injured by the blows they received. The gendarmerie teams struggled to separate the fight. It was determined that Muhammet Baca's nose was broken, and the 14-month-old baby had three cracks in her skull and an injury to her right eye. Both father and daughter were taken to Yalova Training and Research Hospital by ambulance for treatment.
BROTHER RELEASED, SISTER ARRESTED
After the incident, Şener Ergin and Servet Ergin were taken into custody by the gendarmerie teams and taken to the police station. Muhammet Baca filed a complaint, and Şener Ergin, who was taken into custody, was arrested. Servet Ergin was released after being questioned by the prosecutor's office. It was also learned that Muhammet Baca had obtained a restraining order against Servet Ergin, claiming that he left a bullet at his door due to their animosity. Ergin, who denied the allegations, claimed that he received threatening messages.
SCOOTER CONSIDERED A WEAPON
As the investigation related to the incident was completed, the indictment was also prepared. It was stated in the indictment that detained Şener Ergin took a children's scooter located at the entrance of the apartment, ran towards Muhammet Baca, and hit him twice, with the first blow hitting both the father and the baby he was holding. The indictment included the records of the analyzed security camera footage, which showed Şener Ergin swinging an object in the air at the garden gate entrance, with two loud 'thuds' heard. It was emphasized that it was clearly visible that children were present at the scene, and the suspect's failure to notice this was contrary to the ordinary course of life; the children's scooter was considered a 'weapon' due to its potential to cause injury, and the act was assessed as being committed with direct intent against the father and the baby.
PROSECUTOR SOUGHT SEPARATE PUNISHMENTS FOR FATHER AND DAUGHTER
In the indictment, it was requested that detained Şener Ergin be punished for the crime of 'Intentional Injury' against Muhammet Baca with a prison sentence of 3 to 9 years, and for the crime of 'Intentional Injury' against 14-month-old İkra Medine Baca with a prison sentence of 9 to 27 years. The prosecutor requested a total prison sentence of 12 to 36 years. Additionally, it was requested that disqualifications be applied to the detained Ergin in the event of a conviction.
