The forensic reports prepared in the case of the "Newborn Gang," in which 57 defendants, 19 of whom are in custody, are being tried for allegedly transferring baby patients to private hospitals' neonatal units they had previously agreed upon, leading to their deaths and unjust profits, have been submitted to the file. The reports detail the causes of death for 10 babies, the accuracy of the treatments, and the medical faults of the defendants one by one.

In the Forensic Medicine Institution report, it was stated that the Tokluoğlu baby was born with developmental delay and that the baby's death occurred due to insufficient oxygen supply during birth and resulting complications. The report noted that the mother had pregnancy hypertension and that the baby was born with an extremely low birth weight for the gestational week, indicating that the baby had feeding issues in the womb. Furthermore, it was noted that despite the nurse and the responsible physician detecting that the Tokluoğlu baby's heart was beating, they failed to provide appropriate and timely resuscitation support. The report also included information that the doctor on the phone with the nurse stated that there was no need for resuscitation on the patient and that it would be sufficient to show on paper that resuscitation had been performed for 20 minutes, requesting the preparation of a false file.



ALKARİ BABY



Baby Halime Alkari, born on September 29, 2023, died on November 23 at the Neonatal Intensive Care Unit of the Private Çorlu Reyap Hospital, where she was transferred on September 30, 2023. The Forensic Medicine Institution Report indicated negligence due to the physician's absence from the hospital despite needing to be at the patient's side and the lack of effective resuscitation during the resuscitation phase. Additionally, in conversations regarding the writing of the epicrisis between physicians and nurses, it was concluded that there was an impression that 'the causes of the baby's death were being attempted to be made compliant with procedures.' The report prepared by the Forensic Medicine Institution assessed that the death of baby Alkari occurred due to complications arising from premature birth. It was determined that the antibiotic treatment for the baby was not conducted in accordance with medical rules, and it was understood that the resuscitation procedure was performed by auxiliary health personnel, with no information or documents available regarding whether the other health personnel mentioned in the file, except for one nurse, had a neonatal resuscitation program certificate.



SÜLEYMANOĞLU BABY



In the Forensic Medicine Institution report regarding the deceased baby Melek Süleymanoğlu, it was stated that the baby, born at the Private Rami Hospital, was intubated due to insufficient respiration. It was noted that the Süleymanoğlu baby was transferred to the Private Bağcılar Medilife Hospital with diagnoses of 'Respiratory distress' and 'Birth defect'. The report included information that there was physician negligence due to the failure to transfer the baby to a center where surgical intervention could be performed for the heart disease. Additionally, the report stated that the failure to change antibiotics in a timely manner led to an infection in the baby's body, resulting in multiple organ failure. It was reported that there was a faulty medical intervention in the death of the Süleymanoğlu baby.

HELVACI BABY



In the Forensic Medicine Institution report, it was assessed that Helvacı baby, who suffered from respiratory failure due to premature birth, may have died because adequate treatment was not applied. The report included information that Dr. Dursun Eryılmaz was negligent in leaving the CPR task to the nurses, and Dr. İlker Gönen was negligent in misdirecting the CPR.



KADAN BABY



In the report of the Forensic Medicine Institution regarding baby Kadan, it was stated that the baby, who had respiratory failure due to pneumonia from birth, died as a result of respiratory failure and the development of an air leak in the lung due to the intervention performed. It was expressed that the necessary treatment for the baby was not carried out and that there was tampering with the documents. In this context, Dr. Fırat Sarı was evaluated as medically responsible, while the fact that the intensive care conditions did not meet the 3rd level standards but were shown as such was considered an organizational error by the management of the Private Çorlu Reyap Hospital. Additionally, due to the failure to provide appropriate care, monitoring, and treatment for the baby, both Dr. Dursun Eryılmaz, who was responsible for the primary care of the baby, and Dr. İlker Gönen, who took on the responsibility of neonatal intensive care through a contract and canceled the transfer process to another hospital, were stated to be medically responsible.



KARADUMAN BABY



The report stated that the cause of death for Ayaz Karaduman baby was metabolic disease and related complications. It was noted that medical records were arranged in a misleading manner, that there was a delay in the necessary interventions for the baby, and that the nurse intervened with the baby. It was stated that there was no doctor present in the hospital at the time of the intervention, and the patient was lost due to the failure to diagnose and treat early.

The report stated that the cause of death for Havvanur Karakoç baby was 'severe respiratory failure due to chronic lung damage resulting from malnutrition' and 'infection in multiple organs due to blood'. Furthermore, it was found that two epicrisis forms prepared for the baby were inconsistent with each other. It was observed that when transitioning from the second to the third day of the baby's admission, despite the deterioration of the condition, the medication value was decreased instead of increased, but this was not mentioned in the reports.

OPARA BABY

The Forensic Medicine Institution report stated that 5-month-old Opara baby lost their life due to pneumonia and related complications. It was noted that the diagnoses written on the death certificate were not compatible with the baby's age and that the documents did not reflect the truth, with contradictions also found in the epicrises. It was determined that template epicrises prepared for newborns were used to describe the condition of the 5-month-old baby. Additionally, it was found that the treatment and follow-up of the baby were carried out by nurses instead of specialist physicians, medications not included in the doctor's directive were administered by nurses, and information was not provided to the physician in emergency situations. The forensic report emphasized that timely and adequate intervention was not made during the morning hours when the baby's heart stopped, yet the time written on the death certificate was 13:10. The report pointed out that all these findings were not in accordance with medical rules. It was stated that there was a causal link between the diagnosis, follow-up, and treatment process not conducted in accordance with medical rules and the death of baby Opara.

SERDAROVA BABY

The Forensic Medicine Institution report stated that Serdarova baby, who was born normally at 40 weeks, passed away due to congenital heart failure and related complications. The report indicated that regular doctor follow-ups were not recorded in the neonatal intensive care unit of the Private Birinci Hospital, where the baby was referred on August 30, 2023, that blood tests were performed at irregular intervals, and that nutrition and fluid support were not provided as required. Additionally, inconsistencies were found in the antibiotic treatment. Despite the absence of culture results, medications were changed, which was expressed as contrary to medical rules. The report emphasized that the baby was referred to the same hospital after complaints of withdrawal, moaning, and cyanosis after birth, and despite heart anomalies being detected during examinations, the baby was not timely referred to the surgical center as repeatedly suggested by the Pediatric Cardiology specialist.

DEFENDANTS AND HOSPITAL MANAGEMENT FOUND GUILTY

The report stated that considering all the deaths, doctors and hospital management made an organizational error by showing that the conditions did not meet the third-level intensive care requirements while facilitating the admission of newborn babies and organizing the follow-up and treatment process conducted under inappropriate conditions.
