During the summer vacation period, millions of employees have started to take their annual leave. According to the Annual Paid Leave Regulation, employees who will vacation outside the city are entitled to up to 4 days of unpaid travel leave. According to the regulations; those with a service period of 1 to 5 years are entitled to at least 14 days, those working between 5 to 15 years are entitled to at least 20 days, and those with 15 years or more are entitled to at least 26 days of paid annual leave. However, there is an additional right that most employees are unaware of, which is the travel leave.
DOCUMENTATION REQUIRED FOR EMPLOYER FOR TRAVEL LEAVE
According to Article 6 of the Annual Paid Leave Regulation, employees who wish to spend their annual leave outside the city where their workplace is located must be granted up to 4 days of unpaid travel leave, provided they present documentation. According to NTV's report, an employee wishing to benefit from this right must present the place where they will spend their leave with documentation after the dates of their annual leave have been finalized. For example, if a person working in Istanbul is going to vacation in Marmaris, it is sufficient for them to present the invoice of the hotel they are staying at or the rental agreement to the employer.
NOBODY KNOWS THIS RIGHT
In practice, the number of employees using travel leave is negligible. Most employees combine their leave with weekends, resulting in a total of 9 days of rest. However, if the 4-day travel leave is added, this period can extend up to 13 days.
WITHIN THE SCOPE OF UNPAID LEAVE
Travel leave is considered within the scope of unpaid leave. However, it is not mandatory for salaries not to be paid during this period. If the employer wishes, they can include payment for this period as a gesture of goodwill. By law, the employer does not have the right to refuse a travel leave request, but employees must present documentation to utilize this right.
