The 7th Administrative Court of Istanbul ruled to reject the request for the suspension of the execution of the decision made by the Istanbul 5th Administrative Court, which denied the case filed by Ekrem İmamoğlu for the annulment of his diploma.
The Istanbul 5th Administrative Court had rejected the case filed by the CHP's presidential candidate, Istanbul Metropolitan Municipality Mayor Ekrem İmamoğlu, seeking the annulment of Istanbul University’s decision regarding the cancellation of his university undergraduate diploma.
THEY APPLIED FOR APPEAL
İmamoğlu's lawyers appealed the rejection decision of the Istanbul 5th Administrative Court, requesting the "suspension of execution" and "acceptance of the case."
In the application petition, it was stated, "It is absurd to expect our client, who has completed the 1st year of university and applied under the conditions stipulated for horizontal transfer, to know the correspondence between various universities and YÖK, considering that there is no obligation foreseen, that it is indisputable that no opinion and/or approval from YÖK was sought in the legislation, and that the questions asked by the relevant universities for the purpose of consulting YÖK only arose for a portion of the hundreds of horizontal transfer applications made during that period, and that the answers given regarding these questions do not have the nature of a general regulatory act and/or have not been announced to the public."
REJECTED
The Istanbul Regional 7th Administrative Court examined the request for "suspension of execution" in the application. The court decided to reject the request for the suspension of execution of the Istanbul 5th Administrative Court's rejection decision regarding the annulment request. The decision stated, "The decision subject to the appeal does not require the suspension of its execution."
