In the case regarding the death of 4-year-old Leyla Aydemir, whose lifeless body was found after going missing in Ağrı in 2018, the 1st Criminal Chamber of the Court of Cassation overturned the acquittal decision for 7 defendants.

AN ACQUITTAL DECISION HAD BEEN GIVEN FOR 7 PEOPLE

The Ağrı 1st High Criminal Court had acquitted defendants Ayşe A., Besim D., Hatun D., Mehmet Ali A., Musa A., Yıldırım A., and Yusuf A. in 2021 on charges of "qualified intentional murder" and "deprivation of liberty."

The Erzurum Regional Court of Justice 1st Criminal Chamber, which reviewed the appeal of the decision, upheld the acquittal decisions by rejecting the applications of the public prosecutor and the plaintiffs' representatives.

COURT OF CASSATION'S DECISION TO OVERTURN

However, the Court of Cassation overturned this decision on the grounds of insufficient investigation. The ruling stated that it was not investigated who made a social media post on the dates when the incident occurred, and that the identification of individuals mentioned in a CD recording related to the incident and taking their statements had not been carried out.

The Court of Cassation ruled that the deficiencies should be remedied and a retrial should be conducted. The case file was sent back to the Ağrı 1st High Criminal Court for reevaluation.
