An indictment has been prepared regarding the incident in which 16-year-old Atlas Çağlayan was killed by suspects under the age of 18 in Güngören. A prison sentence of 13 years and 6 months to 21 years, 7 months, and 15 days has been requested for E.Ç., who stabbed Çağlayan to death.

In the Bakırköy Chief Public Prosecutor's Office, an indictment was prepared against E.Ç., who fatally stabbed 16-year-old Atlas Çağlayan during a fight in Güngören, on charges of "intentional murder of a child," "violation of Law No. 6136," and "threatening with a weapon in a chain." The requested prison sentence ranges from 13 years and 6 months to 21 years, 7 months, and 15 days.

The indictment states that on January 14, during a dispute between two groups at a café located on Emek Street in the Mehmet Nesih Özmen neighborhood, the child involved in the crime (CIC) E.Ç. stabbed the victim Atlas Çağlayan, who later died in the hospital to which he was taken.

The indictment includes statements from four child victims related to the incident.

Victim D.Ç. stated that he went to the café with his friends, and later Atlas Çağlayan joined them, explaining that from the moment they entered, E.Ç. was looking at them.

D.Ç. reported that a child with E.Ç. asked them, "What are you looking at?" and then E.Ç. intervened, saying, "Are you strong enough to take on a little kid? What are you looking at?" and "Come outside." When they went outside, E.Ç. addressed them, saying, "I will kill you, I will stab all of you." He mentioned that when they saw the knife, they pushed E.Ç. away to prevent him from doing anything, and that Atlas Çağlayan pushed E.Ç., who then stabbed the knife into Çağlayan's chest area.

The indictment notes that in the report obtained from the Forensic Medicine Institution, it was recorded that E.Ç. had sufficiently developed the ability to perceive the legal meaning and consequences of his actions regarding the crimes of "intentional murder," "threatening with a weapon," and "violation of Law No. 6136."

E.Ç., whose statement is included in the indictment, claimed that on the day of the incident, he encountered the victim and his friends at the café, asserting that he did not know the other side beforehand, that they were constantly looking at them, and that they followed them after they left the café.

E.Ç. alleged that Atlas Çağlayan approached him, cursing and asking, "What are you looking at?" and for this reason, he stabbed him once in the stomach and swung the knife twice without hitting. He stated that he fled after the incident but returned to the scene of the crime of his own accord after a friend told him to "surrender."

E.Ç. explained that his friend took the knife from him while they were fleeing, and after arriving at the scene, they threw his knife on the ground upon the instruction of a male individual, asserting that he did not threaten anyone.

The indictment states that Atlas Çağlayan's death occurred due to internal bleeding resulting from a penetrating injury caused by a sharp object.

The indictment, which also includes video examination reports, assessed that the knife used in the incident was similar to the folding knife prohibited under "Law No. 6136" in terms of its manufacturing status, type, and characteristics.

PHOTOS WITH A WEAPON ALSO IN THE INDICTMENT

The indictment highlighted that an examination of Çağlayan's phone revealed no evidence that he had previously known E.Ç. or had any enmity with him, while it emphasized that E.Ç.'s phone contained multiple photos of him holding a weapon, photos of weapons alone, and a photo of a knife.

The indictment stated, "In the context of the case, the fact that the CIC continued his actions while having the opportunity to withdraw and leave the scene, and instead of hitting the victim in another area or hitting once, stabbed the victim three times in the vital areas of the victim, namely the chest and the lower part of the heart, with a knife of a suitable nature, clearly indicates that his intent was to kill," was included.

In the indictment, it was evaluated that Atlas Çağlayan, who had not yet turned 18 on the date of the incident, should be considered a child under the Turkish Penal Code, emphasizing that the intentional murder of a child constitutes an aggravated circumstance.

Due to E.Ç.'s act of causing the death of Çağlayan, who is considered a child, by stabbing him three times in the vital areas of his chest and the lower part of his heart with a suitable knife, the indictment stated that he fell under the crime of "aggravated intentional murder," and it was noted that the knife used by E.Ç. in the incident fell under the crime of "violation of Law No. 6136."

UP TO 21 YEARS OF IMPRISONMENT REQUESTED

The indictment stated that E.Ç. threatened multiple victims by pointing a knife at them in a single act, indicating that this person pointed the knife, which is considered a weapon, at the victims D.Ç., Y.O.O, T.U.A., and R.O., and that his words and actions, "I will shoot you, I will stab all of you. I will kill you," were in line with the statements of the victims and compatible witness testimonies, thus falling under the crime of "chain threat with a weapon."

The indictment requested that E.Ç. be sentenced to a total of 13 years and 6 months to 21 years, 7 months, and 15 days in prison for the crimes of "intentional murder of a child," "violation of Law No. 6136," and "threatening with a weapon in a chain."

The indictment was sent to the Bakırköy Children's Heavy Criminal Court for evaluation.
