On January 24th, around 08:25 in the historical flea market in Kadıköy, an incident occurred where Mattia Ahmet Minguzzi was stabbed 5 times by B.B. while shopping at the market. U.B. also kicked Minguzzi. Minguzzi passed away in the hospital after receiving treatment for 15 days.
B.B. and U.B. were charged with 'Intentional Murder of a Child' with a request for imprisonment ranging from 18 to 24 years. An examination was carried out at the Istanbul Regional Criminal Police Laboratory regarding the knife that caused the death of Mattia Ahmet Minguzzi. The prepared report stated that the knife was 10.3 centimeters long, single-edged, pointed, without grooves, with a blunt back, and had a green plastic handle.
A DECISION OF NON-PROSECUTION WAS MADE
In the report prepared regarding the knife used in the murder, it was noted that the knife did not have the characteristics of prohibited knives as specified in the 'Law on Firearms, Knives, and Other Tools.' The Istanbul Anadolu Chief Public Prosecutor's Office stated that the legal elements of the crime were not present and decided not to prosecute B.B.
A STATEMENT FROM THE FAMILY'S LAWYER
Regarding the recent developments, the family's lawyer Rezan Epözdemir also made a statement on social media. Epözdemir stated, "The camera recordings of the park above the Kadıköy Flea Market, where the perpetrators allegedly carried out the first act against our child and where a verbal argument took place, have been deleted due to the expiration of the time limit, and there are no recordings related to the day of the incident. A response letter regarding this has been added to the file today. In such an important trial, the fact that the camera recordings, which should have been seized and collected immediately after the incident, were said to have been deleted after our application for their collection was decided by the court, and the absence of these recordings, which are the most important evidence of the murder, is legally and practically unacceptable.
"IF IT'S NOT A PROHIBITED KNIFE, THEN WHAT KNIFE WILL FALL UNDER THIS CATEGORY?"
Again, it has been determined by the Expertise Report of the Istanbul Regional Criminal Police Laboratory that the pointed knife, 10.3 cm long, used in the murder of our Ahmet, does not have the prohibited characteristics specified in Article 4 of Law No. 6136; based on this, the esteemed Chief Public Prosecutor's Office issued a decision of non-prosecution regarding the crime of "Purchasing, Carrying, or Possessing Knives or Other Tools Without Permission." This decision is also unacceptable. If the knife used in the brutal murder of our child Ahmet is not one of the prohibited knives under Article 4 of Law No. 6136, then what knife will fall under this category?
