Yusuf Ziya Ağır, a 71-year-old man who was arrested for allegedly harassing a South Korean phenomenon during a live broadcast in Kadıköy, appeared before a judge for the first time. It was learned that Ağır had a history of multiple sexual harassment offenses. He was sentenced to 4 years in prison for the crime of "sexual assault by harassment."

The South Korean broadcaster Hyojeong Park (26), known on social media as "Mhyochi," was brought before a judge for the first time after being arrested on June 6 for "simple sexual assault" for allegedly verbally and physically harassing her during a live broadcast in Kadıköy. The hearing took place at the 54th Criminal Court of First Instance in Anadolu, with the detained defendant Yusuf Ziya Ağır present. The complainant Hyojeong Park did not attend, but the lawyers for both parties were present in the courtroom.

"I DO NOT ACCEPT THE CHARGES"

In his defense, detained defendant Yusuf Ziya Ağır stated, "I do not accept the charges. I was just looking at what she was doing that day. I did not know she was a foreigner. My statements are valid. I do not accept the content of the report. I am thinking of my wife."

"THERE ARE MULTIPLE HARASSMENT CASES"

The lawyer for the complainant Hyojeong Park stated, "Even though my client does not speak Turkish, those watching her live broadcast have warned her. The expert report clearly shows that the defendant touched the complainant and the words he used are evident. When we look at the criminal record, there are multiple sexual harassment cases. Such actions are established. Therefore, we request that the detention continue without considering their defenses."

"THE DEFENDANT HAS MADE SINCERE STATEMENTS"

The lawyer for the defendant Yusuf Ziya Ağır stated, "My client claims that he did not act with the intent to commit any crime. I do not find such a live broadcast very sincere. The defendant has made sincere statements. He has also expressed his apologies if there was any misunderstanding. We do not find the complainant's statements sincere. We request his release."

OPINION ANNOUNCED

The public prosecutor requested the defendant to be punished in accordance with the indictment. The opinion requested that the defendant's detention continue.

4 YEARS IN PRISON WITHOUT REDUCTION

The judge, announcing the decision, stated that the defendant had a previous conviction for a similar crime and decided to impose the maximum penalty. Defendant Ağır was sentenced to 4 years in prison for "sexual assault by harassment." Furthermore, the court did not apply any reduction in the sentence.

FROM THE INDICTMENT

It was recorded that Yusuf Ziya Ağır approached the foreign complainant who was broadcasting live on social media and held her hand without her consent for sexual purposes and kissed her hand. It was noted that the complainant pulled her hand away, indicating her discomfort, and subsequently, Yusuf Ziya Ağır walked alongside the complainant, making sexually disturbing remarks and winking while touching her hip. The request was made for the defendant Yusuf Ziya Ağır to be punished with imprisonment of 2 to 5 years for the crime of 'sexual assault by harassment.'
