The 3rd Civil Chamber of the Court of Cassation has taken up the preliminary review of the absolute nullity decision issued as a precautionary measure by the Ankara Regional Court of Appeal regarding the annulment of the CHP's 38th Ordinary Convention. The examining judge will prepare the report, and the substantive review is expected to take place after the start of the new judicial year on September 1st.
The file regarding the 'absolute nullity' decision issued as a precautionary measure by the Ankara Regional Court of Justice concerning CHP's 38th Ordinary Congress, sent to the Court of Cassation, has been taken up for 'preliminary examination' by the 3rd Civil Chamber of the Court of Cassation. After the examining judge completes their review, they will present their report to the panel, and the panel's substantive review is expected to take place after the new judicial year begins on September 1.
REACHED THE COURT OF CASSATION 3 DAYS BEFORE THE JUDICIAL RECESS
On May 21, the 36th Civil Chamber of the Ankara Regional Court of Justice ruled that CHP's 38th Ordinary Congress, held on November 4-5, 2023, was invalid due to 'absolute nullity,' ordering its annulment and that Kemal Kılıçdaroğlu, who was in office before the congress on November 4-5, 2023, along with members of the Party Assembly and the High Disciplinary Board, should provisionally assume duties/be reinstated 'until the decision becomes final.'
After the decision was appealed, the file was sent to the 3rd Civil Chamber of the Court of Cassation for appeal review on Friday, July 17, before the judicial recess starting Monday, July 20.
COURT OF CASSATION PROCESS OFFICIALLY BEGUN
Despite the judicial recess, file registration and distribution procedures can still be carried out during the process. According to information received, the file status at the Court of Cassation changed from 'registration stage' to 'preliminary examination.' Thus, the process at the Court of Cassation has begun.
In the preliminary examination stage, the examining judge to whom the file will be assigned will begin preparing their report, which will be submitted to the panel of the 3rd Civil Chamber of the Court of Cassation, which will make the final decision.
After completing their review, the examining judge will submit the report to the panel of the 3rd Civil Chamber of the Court of Cassation. The substantive review of the file is expected to take place after the new judicial year begins on September 1.
