A precedent-setting decision has been made by the Court of Cassation that closely concerns all married social media users. Liking a photo of the opposite sex has been considered a 'grounds for divorce.'
The Court of Cassation accepted that liking a photo of the opposite sex on social media is a behavior that undermines trust and decided that this situation could be considered a reason for divorce. Lawyer Tevfik İmamoğlu, who warned social media users, stated that the Court of Cassation's 2nd Civil Chamber made a precedent-setting decision.
"AGAINST THE OBLIGATION OF LOYALTY"
Imamoğlu expressed that it was ruled that liking photos of the opposite sex on social media is a behavior that undermines trust, saying, "Actually, the decision is made by the Kayseri 5th Family Court as the first instance court. The plaintiff spouse claimed that her husband acted contrary to his obligation of loyalty by liking photos of other women. The court found the husband to be at fault due to this reason and the context of the case. After the appeal process, the decision was appealed, and the Court of Cassation's 2nd Civil Chamber stated, 'Liking photos of other women is a behavior that undermines trust and is a reason for divorce,' thus signing a precedent-setting decision."
"SCREENSHOTS, MESSAGES, AND INTERACTIONS..."
Lawyer İmamoğlu stated, "With this decision, an important criterion regarding the social media usage of married individuals has entered the judicial system," and used the following expressions: "From now on, courts will evaluate spouses' social media likes within the scope of loyalty and trust violations. Therefore, social media behaviors are now accepted as concrete faults in divorce cases, and these interactions are now among the strong evidence in divorce cases. Screenshots, messages, and all digital interactions are taken into account in determining the fault rate of the parties. I recommend that citizens consider this issue while using social media."
