In the hearing held at the Bakırköy 21st High Criminal Court, detained defendant Mustafa Kemal Zengin and another defendant, Muhammed Emin Orhan, who is detained for another crime, participated via the Audio and Video Information System (SEGBİS). In the hearing, 5 defendants who are not in custody, including Aylin Arslantatar, the complainant Beyda Nur Danış, and the lawyers of the parties were also present.
"YAVUZ IS MY FRIEND"
Defendant Aylin Arslantatar, who is not in custody, stated in her defense, "Yavuz Engin called me to the Büyükçekmece Courthouse. I warned him so that no harm would come to him. I would protect him again if it happened again; Yavuz is my friend. I am on the defendant's stand for a crime I did not commit."
Detained defendant Mustafa Kemal Zengin, in his defense, said, "I am not the defendant of the case; I am the victim. I went to the prosecutor not for the release of Tuğçe Toptemel, one of the defendants in the 'Newborn gang,' but for an injustice that was done. I do not accept the accusations against me and I request my release." After the lawyers' statements, the defendants were requested to be acquitted.
5 YEARS 6 MONTHS IMPRISONMENT
The court panel, announcing its decision, sentenced detained defendant Mustafa Kemal Zengin to 3 years and 6 months for the crime of 'resisting to prevent the duty from being performed,' and 2 years of imprisonment for 'illegally obtaining personal data' against the complainant Halil Emre Yılmaz. Mustafa Kemal Zengin was sentenced to 5 years and 6 months in prison. It was decided that defendant Aylin Arslantatar, who is not in custody, would be sentenced to 1 year and 8 months in prison for 'illegally obtaining personal data' against complainant Halil Emre Yılmaz, while the announcement of the judgment was postponed. On the other hand, it was decided to continue the detention of Mustafa Kemal Zengin, while 11 defendants were acquitted of the charges.
