Israeli Prime Minister Benjamin Netanyahu, for whom the International Criminal Court has issued an arrest warrant, faces the risk of arrest if he travels to any of the 124 countries that are parties to the Rome Statute. While France and the Netherlands have announced that they will enforce the arrest warrant issued for Netanyahu, Italy has stated that it finds the decision incorrect but that both of them would be arrested if they come to the country. Belgium has also expressed its support for the decision.

Clashes between Israel and Hamas, which began on October 7, 2023, continue, and ceasefire negotiations have yet to yield results after more than a year of ongoing conflict. In Israeli attacks, over 44,000 civilians, including women and children, have been killed in Gaza. While condemnations from Western countries are just beginning to emerge against Israel, which has the support of the United States, a very important decision came yesterday from the International Criminal Court (ICC). The ICC announced that it has issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant for war crimes and crimes against humanity committed in Gaza. The ICC also issued an arrest warrant for Hamas leader Mohammed Deif.

CAN BE ARRESTED IF TRAVELING TO ONE OF 124 COUNTRIES

With this decision, Netanyahu and Gallant face the risk of arrest if they travel to any of the 124 countries that have signed the Rome Statute. It is stated that they will have to avoid traveling to the 124 ICC member countries, which include Canada, Australia, the UK, France, Germany, the Netherlands, Belgium, Sweden, and are mostly composed of European Union, African, and Asian countries.

NETANYAHU: WE WILL NOT RECOGNIZE THE DECISION

Israeli Prime Minister Benjamin Netanyahu stated in a statement following the ICC's decision that they would not recognize the arrest warrant. Claiming that the ICC is "biased," Netanyahu alleged that the Court has directed "imaginary crimes" against him and Gallant. Netanyahu argued that the ICC's decision is "antisemitic," asserting that they would not bow to pressures.

US REJECTED THE DECISION

After the ICC's arrest warrant decision against Netanyahu and Gallant, all eyes turned to the statement from the US, Israel's biggest ally. The US administration rejected the decision. Statements from the White House and the Pentagon emphasized that the US opposed the arrest warrant against Netanyahu and Gallant.

DECISION AGAINST PUTIN WAS MET WITH SATISFACTION

On the other hand, the US administration had taken a different stance when the same decision was made against Russian President Vladimir Putin. US President Joe Biden expressed satisfaction with the arrest warrant issued against President Putin for war crimes in Ukraine. The US administration had stated at that time that all countries should comply with this decision, but this time showed the opposite attitude towards Israel.

ONLY PALESTINIAN MEMBER OF CONGRESS WELCOMES THE DECISION

The only Palestinian member of the US Congress, Rashida Tlaib, welcomed the ICC decision and stated, "Netanyahu and Gallant should be arrested and brought before the ICC."

BORRELL: THE DECISION MUST BE RESPECTED

Josep Borrell, the High Representative of the European Union (EU) for Foreign Affairs and Security Policy, stated that the arrest warrant issued by the International Criminal Court (ICC) against Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant should be respected and implemented.

FIDAN: HOPEFUL FOR THE ADMINISTRATION OF JUSTICE

Foreign Minister Hakan Fidan said, "The arrest warrant announced by the International Criminal Court (ICC) against Netanyahu and Gallant is hopeful for the administration of justice." Minister Fidan, in a post on his social media account, stated, "The arrest warrant announced by the International Criminal Court against Netanyahu and Gallant is hopeful for the administration of justice. This decision is an extremely important step in bringing Israeli officials who commit genocide against Palestinians to justice. We will continue to work to ensure that international law is implemented in all its institutions and rules to punish genocide. This is a responsibility we owe not only to the murdered Palestinians but to all oppressed nations and future generations," he said.

WHICH COUNTRIES WILL IMPLEMENT THE DECISION?

According to a report by the Israel-based news channel i24news, France and the Netherlands announced that they would implement the arrest warrant issued for Netanyahu. Although Italy finds the decision wrong, it stated that both would be arrested if they come to the country, and Belgium also announced that they support the decision.

ITALY: WE WILL HAVE TO ARREST THEM

Italian Defense Minister Guido Crosetto stated that he believes the issuance of an arrest warrant against Netanyahu and Gallant is "wrong," but that they would have to arrest them if both come to Italy due to international law. According to a report by the Italian ANSA agency, Crosetto stated in a talk show that he believes the ICC's issuance of an arrest warrant against Netanyahu and Gallant today is "wrong," saying, "Since we are a party to the ICC, we will have to arrest Netanyahu and Gallant if they come to Italy. This is not a political decision; it is the implementation of international legislation."

BELGIUM SUPPORTED

Belgian Deputy Prime Minister Petra De Sutter stated that the European Union (EU) should comply with the arrest warrant issued by the International Criminal Court (ICC) against Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant for war crimes and crimes against humanity committed in Gaza and should suspend its partnership with Israel.

De Sutter, in a statement on her social media account, said, "Europe must comply, impose economic sanctions, suspend the Partnership Agreement with Israel, and support these arrest warrants. War crimes and crimes against humanity cannot go unpunished," she stated.
