A new development has occurred regarding the removal of tables and chairs at Koza Han, one of the historical symbols of Bursa. As a result of a lawsuit filed by a business, the Bursa 3rd Administrative Court has decided to suspend the execution of the eviction process.
In Koza Han, one of the symbols of the city of Bursa and listed as a UNESCO World Heritage Site, the operator who applied to the court against the eviction decision stated that he has been a tenant for approximately 25 years and signed a new lease agreement covering the year 2026 in December 2025. The plaintiff argued that it is unlawful to be evaluated as a "futile intervener" despite the existence of a valid contract.
The court noted that if the eviction process is implemented, it could cause irreparable damages to the commercial reputation and economic activities of the business. The panel unanimously decided to suspend the execution without seeking a guarantee until the defense of the defendant administration is taken and the file is re-evaluated.
10 DAYS GRANTED
Within the scope of the trial process, the Bursa Regional Directorate of Foundations was requested to send all documents related to the property, lease agreement, and determination of "futile intervener." The administration was granted a 10-day period for defense.
Following the decision, tables and chairs were temporarily rearranged in the courtyard of the inn. Koza Han's Board Chairman Erdinç Şentürk and Lawyer Sena Deniz Ersoy made evaluations regarding the process. Lawyer Ersoy stated that if the court appeal is accepted, other businesses could place tables and chairs in the courtyard, provided they do not block the passageways. Ersoy also mentioned that the suspension of execution does not end the file review, and a new lifting decision could be made at a later stage.
BOTH TRADESPEOPLE AND TOURISTS ARE VICTIMS
Koza Han President Erdinç Şentürk stated that they are seeking a "middle ground" to prevent both tradespeople and tourists from suffering. Şentürk noted that discussions with relevant institutions will continue to establish a balance between the ability of the inn's tradespeople to carry out their commercial activities and the preservation of the historical fabric of Koza Han.
