After eating the cake she bought with her friends for her birthday, 25-year-old Remziye Horuz, who fell ill and passed away in Ağrı, has led to the arrest of the bakery owner and two employees, who are facing a request for 9 years in prison each. The indictment included information that the young woman, who had an egg allergy, asked and confirmed whether the cake was egg-free.
The indictment regarding the death of a young woman, a university student who ate a cake she bought from a bakery for her birthday in a student dormitory, has been accepted for the owner of the workplace and two employees who were arrested.
According to the indictment prepared by the Ağrı Chief Public Prosecutor's Office and accepted by the Ağrı Criminal Court of First Instance, the incident occurred on December 1. The indictment, which includes technical reports, camera recordings, witness statements, and minutes, states that Horuz went to the mentioned bakery with her friends B.Y. and S.D. to buy a cake for her birthday celebration.
ASKED IF IT CONTAINED EGGS
It is stated in the indictment that Horuz, who has asthma and an egg allergy, asked whether the cake contained eggs while purchasing it. It was reported that the employee Fatih Y. showed a cake and stated that it did not contain eggs, and that the deceased and her friends asked the cake chef to confirm that it was egg-free. Following this, Fatih Y. called the owner of the business, Yakup A., to confirm that there were no eggs, after which the deceased and her friends purchased the cake and returned to the girls' dormitory belonging to the Credit and Dormitories Institution.
The indictment mentions that after tasting the cake, Horuz fell ill and experienced shortness of breath, and was taken to the hospital by ambulance, where the young girl passed away after a 19-day struggle for life.
"IT IS ESTABLISHED THAT SHE DIED FROM AN ALLERGY"
The indictment states that the bakery owner, suspect Yakup A., did not fulfill his responsibilities as a food business operator and did not provide sufficient training to his staff. It is noted that both employees provided incorrect information regarding the content of the food for which they were responsible for selling. The indictment includes the statement, "It has been established that the deceased died due to health problems arising from her egg allergy, based on the autopsy process and all evidence collected in the file. It is understood that leaving our detained case pending by waiting for the report from the Forensic Medicine Institution, despite this conclusion, will lead to loss of rights."
The indictment requests that the currently detained defendants be sentenced to up to 9 years in prison for the crime of "causing death by conscious negligence."
