The bill to increase traffic fines has been approved by the Parliament. With the law, changes have been made to the Highway Traffic Law, increasing both monetary penalties and the severity of sanctions. The fine for driving under the influence has been raised to 25,000 lira, while drivers who exit their vehicles with the intent to assault in traffic will face an administrative fine of 180,000 lira.
The proposal for the Law on Amendments to the Highway Traffic Law, which includes regulations aimed at increasing traffic fines, has been accepted by the General Assembly of the Turkish Grand National Assembly and has become law. With this law, amendments are made to the Highway Traffic Law. With the accepted regulations, both monetary fines have been increased and sanctions regarding driving licenses and vehicles have been intensified.
DRIVING UNDER THE INFLUENCE
The fine for those driving with an alcohol level above 0.50 promille is increased to 25,000 lira. For those caught driving under the influence for the second time, a fine of 50,000 lira will be imposed, and for the third and subsequent violations, a fine of 150,000 lira will be applied. Drivers using narcotic substances will face a fine of 150,000 lira and revocation of their driving license. Those who do not have their measurements taken by law enforcement will also face the same amount of fine and a 5-year license confiscation penalty.
180,000 LIRA FOR STALKING WITH INTENT TO ATTACK
Drivers who persistently follow another vehicle with the intent to attack or get out of their vehicle for this purpose will face an administrative fine of 180,000 lira. Additionally, the driving licenses of these drivers will be revoked for 60 days, and their vehicles will be banned from traffic for 30 days. The driving licenses of drivers whose licenses are revoked will be returned after undergoing a psychotechnical evaluation.
INCREASED PENALTY FOR UNLICENSED DRIVERS
Those driving motor vehicles without a license will face an administrative fine of 40,000 lira. Those who drive despite having their licenses temporarily or precautionarily revoked, as well as those who drive after their driving licenses have been canceled, will be fined 200,000 lira. Operators who allow individuals with revoked licenses to drive will also face an administrative fine of 40,000 lira based on the registration plate.
RED LIGHT VIOLATION
Drivers who cause an accident due to running a red light will have their licenses revoked for 60 days. A driver who has committed 6 red light violations within one year from the date of the last violation will have their license revoked. Fines for red light violations will increase based on the number of repetitions within a year. For the second violation, a fine of 10,000 lira will be imposed; for the third violation, 15,000 lira; for the fourth violation, 20,000 lira; for the fifth violation, 30,000 lira; and for the sixth violation, 80,000 lira will be fined.
LICENSE OF DRIVERS DOING "DRIFT" MAY BE REVOKED
The law regulates the penalties for drivers performing actions known to the public as "drifting." Drivers performing acrobatic maneuvers will face an administrative fine of 46,000 lira, their driving licenses will be revoked for 60 days, and their vehicles will be banned from traffic for 60 days. The revoked driving licenses will be returned after the period ends, provided that the driver has undergone a psychotechnical evaluation and there are no obstacles to obtaining a driving license, and that the entire administrative fine has been collected. Driving licenses of those whose licenses have been revoked for the second time within 5 years from the date of the last violation will be canceled. Drivers of bicycles, electric scooters, motorbikes, and motorcycles who drive on pedestrian paths will face an administrative fine of 5,000 lira.
GRADUAL PENALTY FOR USING A CELL PHONE
Drivers using cell phones and similar communication devices while driving will face an administrative fine of 5,000 lira. If this rule is violated for the second time within one year from the date of the last violation, a fine of 10,000 lira will be imposed; if the rule is violated 3 or more times within a year, a fine of 20,000 lira will be imposed each time, and the driving licenses will be revoked for 30 days each time.
WEDDING CONVOYS
Those who weave in traffic, drive their vehicles in the opposite direction on highways or divided roads, or stop their vehicles in a way that obstructs or endangers the passage of other vehicles while driving in a convoy or individually will face an administrative fine of 90,000 lira.
FAILURE TO YIELD TO AMBULANCES
Those who do not yield to vehicles with the right of way will face a fine of 15,000 lira, while those who do not clear the way for ambulances or fire trucks will face a fine of 46,000 lira, along with license confiscation and traffic fines.
Those who do not comply with the distance rule between vehicles will face a fine of 5,000 lira, and those who do not comply with the right of way rules at intersections will face an administrative fine ranging from 1,000 to 5,000 lira.
SPEED LIMIT VIOLATION
The law amends the provision regarding the obligation to comply with speed limits in the Highway Traffic Law. Accordingly, drivers will not exceed the speed limits specified in the regulations unless a contrary decision is made and marked. Those exceeding the speed limits specified in the regulations within residential areas by 6-10 kilometers/hour will face a fine of 2,000 lira, 11-15 kilometers/hour will face 4,000 lira, 16-20 kilometers/hour will face 6,000 lira, 21-25 kilometers/hour will face 8,000 lira, 26-35 kilometers/hour will face 12,000 lira, 36-45 kilometers/hour will face 15,000 lira, 46-55 kilometers/hour will face 20,000 lira, 56-65 kilometers/hour will face 25,000 lira, and those exceeding 66 kilometers/hour will face a fine of 30,000 lira. For those exceeding the speed limits outside residential areas by 11-15 kilometers/hour, a fine of 2,000 lira will be imposed; for 16-20 kilometers/hour, 4,000 lira; for 21-25 kilometers/hour, 6,000 lira; for 26-30 kilometers/hour, 8,000 lira; for 31-40 kilometers/hour, 12,000 lira; for 41-50 kilometers/hour, 15,000 lira; for 51-60 kilometers/hour, 20,000 lira; for 61-70 kilometers/hour, 25,000 lira; and for those exceeding 71 kilometers/hour, a fine of 30,000 lira will be applied.
Those violating the speed limit within residential areas by 46-55 kilometers/hour will have their driving licenses revoked for 30 days each time, those violating by 56-65 kilometers/hour will have their licenses revoked for 60 days each time, and those violating by more than 66 kilometers/hour will have their licenses revoked for 90 days each time.
TRAFFIC POLICE
Traffic police responsible for highways may also be assigned as general police if deemed appropriate by the Minister of Interior, limited to their area of responsibility. In places where traffic police are absent or insufficient, general police will be authorized and responsible for regulating traffic and seizing traffic offenses in accordance with the principles and procedures specified in the relevant legislation based on their area of responsibility.
HEAVY TONNAGE PERMIT CONDITION
Permission will be obtained from the General Directorate of Highways (KGM) for the transportation and traffic of special loads. A road usage fee will be charged for these vehicles. The fee to be paid will be announced each year based on criteria such as axle tonnage, number of axles, and transportation distance. The procedures and principles for permits will be determined by the Ministry of Transport and Infrastructure. If traffic police support is obtained, a service fee of 16,000 lira will be applied daily.
FAILURE TO OBEY "STOP" SIGNAL
Drivers who flee from the police's "stop" signal will be fined 200,000 lira. The licenses of these drivers will be revoked for 60 days, and their vehicles will be banned from traffic for 60 days.
CHANGE OF LICENSE PLATE
Drivers who use license plates that do not comply with the specifications or measurements specified in the regulation, or who do not use the required number of license plates, will be fined 4,000 lira. These vehicles will be banned from traffic until their plates are brought into compliance. Those who use a registration plate belonging to another vehicle, a temporary registration plate not issued by the organization that performs the plate printing process, a plate without a registration record, or a fake plate will be fined 140,000 lira, and their driver’s licenses will be revoked for 30 days, and the vehicle may be banned from traffic for 30 days. Drivers who intentionally alter their plates to cause them to be read differently or not at all will be fined 140,000 lira, and their vehicle will be banned from traffic for 30 days.
