The expert, witness, and mediation fees for 2026 have been announced. According to the tariff published in the Official Gazette, the mediation fee has increased to 9,000 TL, while the expert fees have risen to 6,600 TL.
The Ministry of Justice has determined the minimum wage tariffs for expert witness, witness, and mediation services to be implemented in 2026. The new tariffs will come into effect on January 1, 2026, and have been finalized by being published in the Official Gazette.
MEDIATION FEE SET AT 9,000 TL
According to the 2026 Mediation Minimum Wage Tariff, if an agreement is reached at the end of the mediation process, the mediation fee is set at 9,000 TL, regardless of the amount of the agreement.
In cases of serial disputes, if an agreement is reached, the fees applicable for each dispute are as follows:
In commercial disputes: 7,500 TL
In other disputes: 6,000 TL
The new tariff also stipulates that in disputes regarding the dissolution of partnerships and in commercial disputes, if an agreement is reached at the end of the mediation process, the mediation fee cannot be less than 13,000 TL.
PARTIES WILL PAY FEES EQUALLY
Unless otherwise agreed, the mediation fee will be paid equally by the parties. If new dispute topics arise during the mediation activity related to a specific dispute, a separate fee will be charged for each dispute.
WITNESS COMPENSATION OF 130-200 TL PER DAY
With the 2026 Witness Fee Tariff published by the Ministry of Justice, the amount of compensation to be paid to witnesses during the criminal proceedings has also been determined.
Accordingly, considering the time lost due to witnessing, witnesses will be paid between 130 TL and 200 TL per day.
According to the tariff, if a witness needs to travel to be present, travel expenses and accommodation and feeding expenses at the location where they are called to witness will also be covered. No tax, fee, or charge deductions will be made from the compensation and expenses to be paid to witnesses.
EXPERT WITNESS FEES REDEFINED
The 2026 Expert Witness Fee Tariff, which regulates the fees to be paid to expert witnesses in return for their labor and time, has also been published in the Official Gazette. Accordingly, the authority that assigns the expert witness will have the right to increase or decrease the expert witness fee when deemed necessary.
REAL PERSON EXPERT WITNESS FEES
According to the tariff, the expert witness fees to be paid to real persons are determined as follows:
- Enforcement and bankruptcy offices and sales offices: 2,200 TL
- Peace courts and consumer courts: 2,200 TL
- Enforcement law and enforcement criminal courts: 2,200 TL
- First instance civil courts: 3,600 TL
- Family, labor, and cadastral courts: 2,800 TL
- First instance commercial and intellectual and industrial rights courts: 4,100 TL
- Administrative and tax courts: 3,600 TL
- Public prosecutor's office investigations: 2,200 TL
- Peace criminal courts: 2,200 TL
- First instance criminal courts: 6,600 TL
- Heavy criminal courts: 4,100 TL
- Regional courts of appeal and regional administrative courts: 4,200 TL
- Cases and matters seen in the Supreme Court and Council of State as first instance: 5,100 TL
5,900 TL FOR PRIVATE LAW LEGAL ENTITIES
According to the new tariff, the expert witness fee to be paid to private law legal entities is set at 5,900 TL.
The newly determined tariffs will be in effect as minimum wages applicable in judicial processes throughout 2026.
