The Court of Cassation upheld the 3-month prison sentence given to a person who pressed the doorbell of their former neighbor, with whom they had a dispute, and fled, finding it in accordance with the law.

The 12th Criminal Chamber of the Court of Cassation upheld the 3-month prison sentence given to a person who rang the doorbell of his former neighbor, with whom he had a feud, and fled, finding the sentence for "disturbing the peace and tranquility of individuals" to be lawful.

HE DISTURBED HIS NEIGHBOR DESPITE MOVING AWAY

According to the chamber's decision, a person living in Antalya moved to another place after experiencing problems with his neighbors. After moving, the feud with his former neighbor continued, and he came to the front of the house at night, rang the doorbell, and fled. The former neighbor, disturbed by the incident, filed a criminal complaint against this person.

3 MONTHS OF PRISON SENTENCE WAS GIVEN

The defendant, who appeared before the judge for the crime of "disturbing the peace and tranquility of individuals" regulated in Article 123 of the Turkish Penal Code, was sentenced to 3 months in prison by the Antalya 24th Criminal Court of First Instance. The defendant, who claimed that he did not commit the alleged crime and that there were no witnesses or evidence against him, appealed the decision.

THE COURT OF CASSATION UPHELD THE SENTENCE

The 12th Criminal Chamber of the Court of Cassation, which conducted the appeal review, found the conviction decision against the defendant to be lawful and ruled for its unanimous approval.

In the chamber's decision, it was stated that it was established that the alleged crime was committed by the defendant based on the collected evidence, and that the court correctly determined the nature of the crime and the penalties applicable to the act, thus the request for appeal was rejected.
