The 11th Judicial Package, which includes the COVID regulation, has been presented to the Parliament. Sharing the details of the regulation, AK Party Group Chairman Abdullar Güler stated, "Under the 11th Judicial Package, GSS debts will be erased. As every year, we are also adding a proposal to our bill regarding the abandonment of the collection of principal and accessory debts related to general health insurance premiums as of 2015-2016."

The 11th Judicial Package, which includes the Covid regulation, has been presented to the Parliament. With the regulation expected to benefit 55,000 prisoners, supervised release will be three years earlier. AK Party Group Chairman Abdullar Güler stated, "GSS debts will be erased within the scope of the 11th Judicial Package."

Important statements from AK Party Group Chairman Abdullar Güler; "We propose that if the subject of the crime of abuse of trust involves a motor, land, sea, or air vehicle, the penalty to be imposed should be increased by one fold. Especially in recent years, we have seen an increase in actions such as rental vehicles not being returned, being dismantled and sold as vehicle parts, having their parts changed, or being used in crimes. We are also including more deterrent sanctions in this proposal.

"WE ARE PROPOSING SOME REGULATIONS ON COMPUTER CRIMES"

We are also proposing some regulations regarding computer crimes due to the recent fraudulent actions that have harmed our citizens. In this context, we are providing an opportunity for the relevant bank account to be suspended by banks and financial institutions for up to 48 hours in cases where crimes are committed using information systems, provided that the affected party consents to the reactivation of the account. Because we are developing a measure to seize or suspend the money identified as being used in the crime by judicial authorities.

Otherwise, we will at least alleviate the difficulties faced by our citizens who have been defrauded in accessing their money, which has been transferred to many accounts. Because in the long term, dear friends, when we look at certain incidents, we see that some elderly or disabled citizens have been defrauded by individuals posing as police, prosecutors, or public officials, leading to a certain amount of money being transferred from their accounts to different accounts.

LIMITS ON GSM LINES

We are introducing a standard that allows GSM line subscriptions to be made with chip ID cards. We are imposing a limitation on the number of lines. Phone lines belonging to deceased individuals will be checked every three months. Inactive lines will be closed. We are establishing a certain standard for mobile lines belonging to foreign nationals. Diplomatic relations and foreign mission officials will be exempt from this.

GSS DEBTS WILL BE ERASED

We are enabling the prosecution of fraud charges regulated under Article 158 of the Turkish Penal Code to be conducted in criminal courts of first instance. As every year, we are also adding a proposal to our bill regarding the waiver of the collection of principal and accessory debts related to general health insurance premiums as of 2015-2016. There is also an important regulation in our bill. The principle of equality is one of the cornerstones of our justice system. As you all know, due to the pandemic that started in 2020, some measures were developed by our Ministry of Justice every three months based on the opinions and recommendations of the Health Ministry's Science Board to address potential risks in penal institutions. Under these measures, we had implemented some regulations in the execution law. These regulations were last applied to prisoners in penal institutions as of July 31, 2023, and these measures had ended. Especially, we received feedback from our citizens and political parties that this regulation, known among citizens as the "Covid 19 regulation," caused inequality.

WE HAVE REVISED THE SCOPE OF THE COVID 19 REGULATION

That is to say; even if the offenses were committed on the same date, due to the slow pace of the trial, a disparity in the application of conditional release and supervised release periods emerged among prisoners whose sentences were finalized and who entered penal institutions as of July 31, 2023, and those whose sentences had not yet been finalized during this period. Taking all these opinions, objections, and expectations into account, we have revised the scope of the Covid 19 regulation.

With this regulation, we are providing the opportunity for those who will be sentenced for offenses committed on or before July 31, 2023, to benefit from the arrangement that allows for earlier separation from closed penal institutions to open penal institutions or supervised release, which was available to prisoners in closed penal institutions as of July 31, 2023.

Accordingly, for offenses committed on or before July 31, 2023: We are introducing the possibility of separating from closed penal institutions to open penal institutions three years earlier, and from open penal institutions to supervised release three years earlier. By adding the phrase "those who commit crimes" to this administrative measure applied to prisoners before July 31, 2023, we will ensure that it is also applied to new prisoners, thus establishing a rule of equality. In this way, we will also implement this practice.
