The bill, which includes regulations related to taxes, was accepted by the General Assembly of the Turkish Grand National Assembly and became law. While a limit of 2 times was imposed on real estate tax values, the penalty for tax loss due to underreporting in title deed fees has also increased fourfold. From now on, the tax loss penalty will be applied as "one time" instead of 25 percent.

The bill amending the Tax Laws and Certain Laws, including tax regulations, and the Decree Law No. 631 has been accepted by the General Assembly of the Turkish Grand National Assembly (TBMM) and has become law.

Accordingly, the tax values for buildings and land calculated for the year 2026 can be at most twice the tax values for the year 2025. In the period of 2027-2029, tax values will be determined by increasing the previous year's tax base by the revaluation rate.

If it is determined that a fee has been paid on a value lower than the real estate tax value after the transaction in the land registry, or that the declared transfer and acquisition value does not reflect the actual situation, the tax loss penalty will be applied as "one time" instead of 25% on the tax calculated on the difference.

Mustafa Hakan Özelmacıklı, Chairman of the Board of Altın Emlak Global, who evaluated the law on the amendment of the Tax Laws and Certain Laws and the Decree Law No. 631 accepted in the TBMM General Assembly, emphasized that the regulation is critically important for the real estate sector.

Özelmacıklı stated, "The fact that an upper limit has been set for increases in real estate taxes is a pleasing step for our sector. Limiting the tax values for 2026 to a maximum of twice the values of 2025 will protect taxpayers from a high tax burden and reduce uncertainty in the market. Increases in the coming years will be applied based on half of the revaluation rate. Additionally, the proposed change regarding the exemption for residential rental income, which was expected to be removed in the Planning and Budget Commission, has been abandoned for now," he said.

Providing information about the regulation aimed at ensuring that actual declarations are taken as the basis in real estate sales, Özelmacıklı stated, "With the amendment to the Fees Law, the tax loss penalty to be applied in case of detecting incomplete declarations in the title deed fee has also increased 4 times. In this context, the declared amount in real estate transactions will be calculated as not less than the real estate tax value, and the tax penalty to be applied for discrepancies in declarations, which is currently 25%, will be applied at one time more. The same rate will apply to the transfer and acquisition of properties based on compensation or under the provisions of exchange. We are also expecting a declaration amnesty regulation here," he said.

Özelmacıklı also evaluated the regulation regarding the collection of annual fees for authorization documents related to real estate trade, stating, "The regulation will create a new financial burden for businesses that operate in a registered and compliant manner. Businesses engaged in real estate trade and contracted businesses will pay a license fee of 20,000 TL each year, and 40,000 TL within the boundaries of metropolitan municipalities. There are 87,941 businesses with authorization documents across Turkey. With this new fee, especially cancellations will occur among contracted businesses, and informality may increase. In a market where service fees are limited, duplicate advertisement entries continue, and there is no obligation to work with real estate businesses, the presence of a large informal workforce is a significant problem. Therefore, I believe that the annual fee introduced should be supported by additional measures to reduce unfair competition in the sector," he said.
