For the other 7 detained defendants, it was requested that they be punished with imprisonment from 15 to 20 years for the crime of 'aiding and abetting in the killing with premeditation and inflicting torture with monstrous feelings against a woman'. Following the determination that Oğuz Kal participated in the crime committed by defendant Cemil Koç, aggravated life imprisonment was requested for the crime of 'participation in the killing with premeditation and inflicting torture with monstrous feelings against a woman' and imprisonment from 3 to 12 years for other crimes.
WHAT HAPPENED IN YESTERDAY'S HEARING?
On the second day of the hearing held at the Küçükçekmece 2nd High Criminal Court, 9 defendants, including 8 detained ones, along with complainant Esra Tokyaz, defendant and party lawyers, and a large number of spectators attended. Intense security measures were taken during the hearing.
THE HEARING STARTED WITH TENSION
After the parties were present in the courtroom, complainant Esra Tokyaz said to defendant Cemil Koç, "Cemil, today Esra is in front of you, you will face me today, you are finished. Should I call you Cemil or Cem?" In response, defendant Cemil Koç said, "I am enough for all of you." The tension that arose between the parties ended when the gendarmes present in the courtroom intervened. The hearing began with the defendants' statements being taken.
"IF THERE IS A STAIN ON THE T-SHIRT, IT COULD HAVE HAPPENED DURING THE ASSAULT"
In his defense, defendant Cemil Koç stated, "I had an extra t-shirt in my car along with a tank top and shorts. I bought 2-3 t-shirts, 4-5 tank tops. The t-shirt I threw in the trash at the gas station was an old and stained t-shirt. There was no blood stain. If there is a possible stain, it could have happened during the assault, it is something as small as a needle tip. This is consistent with the ordinary course of life. It was an event I had never experienced before, I inevitably sweated, and that is why I threw the t-shirt in the trash."
"ESRA'S RECORD MAY HAVE BEEN CUT AND EDITED"
In his defense regarding the taking of Esra Tokyaz's statement, Koç said, "I do not remember the name of the personnel. The recording shared by Esra has been cut and edited. I request the examination of the video. When Cemal and Esra came, Ayşe had already passed away. I panicked a lot at that moment. Later, I thought of calling Uğur brother. I said, 'Uğur brother, I need you, I have a problem, come.' He asked me, 'Is it urgent?' I said it was urgent." Koç claimed that the person named Uğur did not enter the house, saying, "I told him to wait outside. He kept asking questions, but he said, 'You can explain later.' With the psychology of that moment, when I called because Uğur brother came, I put Ayşe in the suitcase. Later, I went out to pick up Uğur brother, thinking we would talk at home, but he did not come home. He may have become suspicious later."
"I GAVE IT TO BE BURIED"
In his defense, Koç stated, "I know Necmettin as a taxi driver, we met at the tavern. I gave him the suitcase to have someone bury it. Necmettin told me, 'I can't do it, but I can find someone who can.'"
"HE TOLD ME THERE IS BLOOD AND SMELL"
Detained defendant Necmettin Ecer, in his defense, stated, "I encountered defendant Cemil Koç at the tavern. He had 2 people with him whose identities I do not know. Cemil made me sit at a separate table. He asked me if I would help with a bag in the trunk of his vehicle. I initially refused. He insisted several times. Due to our closeness, I wanted to help. I accepted when he offered money. I said I could find someone. These are mentioned in my statements. I did not offer money to Barış Can. I spoke to Barış Can via video at the tavern. I said there is something in the trunk. It needs to be buried. I said we would be paid for this. We were supposed to receive 100,000 lira per person. Barış Can and Erhan were next to me. They said they were going to pick up Yusuf Ziya. When they arrived, Erhan was driving the vehicle. Barış Can was sitting in the front seat. I definitely did not see Yusuf Ziya. Barış Can took the bag out of the trunk by himself. He put it in the trunk of his own vehicle. I am the first person to be detained. I helped the police to find the bag. I called Barış Can in front of the police. He told me, 'There is blood and smell.' I said, 'Come back, we are going to get into trouble.' On my second day at the police station, I learned what was in the suitcase."
MOTHER TOKYAZ WAS UNCOMFORTABLE WITH THE DEFENSE
While defendant Necmettin Ecer was making his defense, Ayşe Tokyaz's mother became uncomfortable with the words in the defendant's defense. Complainant Esra Tokyaz shouted by hitting a water bottle. Following this, mother Halime Tokyaz and Esra Tokyaz left the courtroom.
"IF CEMIL IS RELEASED TODAY, HIS FIRST JOB WILL BE TO KILL ESRA"
Abdulkadir Tokyaz, the brother of complainant Ayşe Tokyaz, stated, "We have never known Cemil Koç. We can no longer continue our lives. He says, 'I will speak last.' He will listen to us and then slander us."
I'm sure it will come out today, it will first kill Esra. We want justice to be served, thinking of the whole family," she said.
"STOP SLANDERING MY DAUGHTER"
Ayse Tokyaz's mother, Halime Tokyaz, said, "Cemil called us, made himself likable. He said, 'I will come to kiss your hand.' I am not an irresponsible mother. I am protecting my daughter. He should account for how he killed my daughter, he should stop slandering her."
While the mother was making her statement, Esra Tokyaz threw a bottle at Cemil Koç and said, 'Look what you've done to us.'
