E.Ç., who killed his friend, was initially sentenced to 15 years in prison, but this sentence was overturned by the Court of Appeals. The court stated that the defendant should be punished with life imprisonment. The case will be heard again in the Heavy Penal Court.

WENT TO MERSIN FOR MONEY, CONFRONTED THE BITTER TRUTH



E.Ç., living in Diyarbakır, accepted the offer of his 20-year friend Y.B. and went to work in Mersin. His wife S.K. and their children stayed in Diyarbakır. After a while, E.Ç., whose communication with his wife weakened, began to suspect. When his wife did not respond to video calls made via phone, E.Ç.'s suspicions increased, and he realized that his wife was live streaming on an application called "Vigo" and was living in Anamur. The person who learned the situation determined that his wife had rented a house there. After a while, E.Ç. reconciled with his wife and started living together again, but after further arguments, he returned to Diyarbakır.



CAUGHT WITH HIS FRIEND



According to a report in Sözcü; on the day of the incident, when E.Ç. went to his wife's house to see his child, he saw that his friend Y.B. had taken his wife into his vehicle. Following the vehicle, E.Ç. noticed that the two stopped in an open area on a village road outside the city. After waiting for a while, the person approached the vehicle and caught his wife and friend in a relationship. Enraged, E.Ç. broke the car window and attacked Y.B. and his wife. After assaulting the couple, E.Ç. also beat his wife there. A few days after the incident, when Y.B. called S.K. and was seen around her house, E.Ç. became sure that his wife had cheated on him again. When it was determined that the couple had stayed in the same room three times in an apartment, E.Ç. took his gun and went after Birol.



FIRED 10 SHOTS



On the day of the incident, E.Ç., who argued with his friend, shot Y.B. 10 times with the gun he was carrying. In his statement at the court, he said, "My friend of 20 years, the man I called my brother, had a relationship with my wife. My wife told me, 'He got into my head, he deceived me.' I regret it."



COURT SENTENCED 15 YEARS IN PRISON



The Diyarbakır 1st Heavy Criminal Court, concluding that conditions of unjust provocation existed in the incident, initially sentenced the defendant to life imprisonment and then to 15 years in prison. The court stated that the defendant's wife cheating on him and the existence of records regarding this constituted a provocation element.



COURT OF APPEALS: PROVOCATION CONDITIONS DID NOT OCCUR



However, the Regional Court of Appeals overturned the decision. The justification emphasized that the unofficial marriage between E.Ç. and S.K. had effectively ended, that they lived separately, and that there was no legally protected union between them. The court evaluated, "The defendant cannot benefit from the provisions of unjust provocation due to S.K. having a relationship with someone else, as the marriage relationship is no longer ongoing." With this justification, it was ruled that E.Ç. should be sentenced to life imprisonment, and the case was sent back to the Heavy Criminal Court for reevaluation.



CASE TO BE REVIEWED AGAIN



In the retrial, E.Ç. is expected to receive a life sentence for the crime of "intentional murder." The family of Y.B., who lost his life in the incident, supported the decision by stating, "This is a murder, it cannot be explained by provocation."
