The 9th Judicial Package has been published in the Official Gazette and has come into effect.

The law known to the public as the 9th Judicial Package, titled "Law on Amendments to Certain Laws," has been published in the Official Gazette with the signature of President Erdoğan. According to the law, the number of questions in the Legal Professions Entrance Exam and the Administrative Jurisdiction Preliminary Exam will be increased from 100 to 120.

6-MONTH CONDITION FOR IMPOUNDED PARKING LOT

The sale procedure for vehicles in impounded parking lots that are held due to being found or are seized from traffic according to the provisions of the law and are not claimed or searched for by their owners within 6 months will be redefined. The crime of insult through verbal, written, or visual communication will be removed from the scope of reconciliation and included in the scope of pre-payment.

REQUIREMENT OF LAW GRADUATE FOR MEDIATORS

For the crime of insult, which is subject to investigation and prosecution based on complaint, the complaint period cannot exceed 2 years from the date the act occurred, regardless of how it occurs. Those who complete mediation training and have 20 years of seniority in their profession will be able to register in the mediation registry without taking a written exam. A requirement of being a law graduate will be introduced to become a mediator.

With the amendments accepted by the AK Party, provisions regarding the surname of the married woman, the appointment of the Savings Deposit Insurance Fund as a trustee, and changes in the Expropriation Law have been removed from the regulation. Additionally, the law, which contains many articles, came into effect on the date of publication.

WHAT IS PRE-PAYMENT?

Pre-payment is an institution that allows the prosecutor to eliminate the dispute with a decision of non-prosecution in exchange for the suspect paying a fine, despite having sufficient evidence to suggest that the suspect committed the crime. Pre-payment is an obstacle to prosecution. Prosecution cannot continue without a pre-payment proposal being made and the result awaited. The acceptance of the pre-payment proposal is also an obstacle. When the proposed pre-payment is accepted during the prosecution phase, the court will issue a decision of dismissal.
