In a divorce case in İzmir, the court ruled that the woman must pay the unemployed man a monthly alimony of 5,000 TL, taking into account the social and economic conditions of both parties. The lawyer stated, "This decision by the court not only breaks the established perceptions in society but also serves the intended purpose when the law is applied correctly."
S.B. and Ş.B., residing in the Tire district of İzmir, got married in November 2023. After being married for about two years, the couple decided to divorce in August due to incompatibility. A divorce case was filed at the Tire 2nd Civil Court of First Instance as a family court. The parties could not reach an agreement for a consensual divorce and both requested alimony from each other. The second hearing of the divorce case was held on November 20. Both parties and their lawyers attended the hearing.
WOMAN TO PAY ALIMONY TO MAN
S.B.'s lawyer A. İslam Gezer stated that his client was dismissed from work and unemployed, requesting provisional alimony for this reason. Ş.B.'s lawyer requested the rejection of the request. The judge, considering the social and economic conditions of the parties, decided that Ş.B., who runs a bakery, should pay S.B. a monthly provisional alimony of 5,000 lira from the date of the lawsuit until the conclusion of the proceedings.
"FAULT IS NOT CONSIDERED IN PROVISIONAL ALIMONY"
A. İslam Gezer, one of S.B.'s lawyers, said, "Provisional alimony is a financial measure intended to support the party that is socially and economically weaker. When the court rules on provisional alimony, the fundamental element taken into account is the social and economic status of the parties. No fault is considered when a provisional alimony decision is made. Since women and men have equal rights before the law, it is also possible to rule in favor of the man for this alimony if he is socially and economically weaker. In the case at hand, it was understood that the man was unemployed and needed support both economically and socially, thus provisional alimony was ruled in favor of the man."
"A DECISION THAT SHATTERS STEREOTYPICAL PERCEPTIONS"
Elif Büşra Berber, one of S.B.'s lawyers, stated, "The established perception in society that alimony during divorce is only ruled in favor of women and children does not reflect reality and is contrary to the spirit of the law and justice. Moreover, if conditions are met, this provisional alimony can turn into a poverty alimony ruled in favor of the man after the case. Considering the provisions of the Civil Code, which state that women and men have equal rights, and the purpose of the alimony institution, the court has made a sound decision and ruled provisional alimony in favor of the man. This decision of the court not only breaks the established and stereotypical perceptions in society but also serves the purpose intended when the law is fully applied."
