One of Turkey's long-established airline companies, Atlasglobal, has officially declared bankruptcy. The bankruptcy process, which began on June 17, 2021, has come to an end with the examinations and approval decision made by the 6th Civil Chamber of the Court of Cassation.
Atlasglobal (Atlasjet Aviation Inc.), one of Turkey's established airlines in the aviation sector, has officially declared bankruptcy. The company, which declared bankruptcy in June 2021, received approval from the Court of Cassation.
The Bakırköy 3rd Commercial Court had decided on the bankruptcy of Atlasglobal on June 17, 2021, and the case had been taken to the Court of Appeals. The Court of Appeals, examining the files related to bankruptcy, stated that according to Article 376/3 of the Turkish Commercial Code, there should be a decision by the company's board of directors to request bankruptcy, but no such decision was found in the file or UYAP, and therefore, the decision of the Bakırköy 3rd Commercial Court, numbered 2020/135 Esas, 2021/528 decision, dated June 17, 2021, was annulled.
THE FIRST HEARING STARTED IN 2023
With the decision of the Court of Appeals, the case was returned to the commercial court for a new decision to be made in accordance with the judgment. In September 2022, another hearing was held, and the bankruptcy decision given for Atlasjet Aviation Inc. on June 17, 2021, was overturned.
According to the news in Ekonomim, the decision to lift the bankruptcy, numbered 2022/1308 Esas, 2022/1031, taken by the Istanbul Regional Court of Justice (Court of Appeals) on September 22, 2022, was re-examined by the Istanbul 3rd Commercial Court. After the examination, it was stated that the missing files that the Regional Administrative Court found were actually included in the case documents and there was no other issue to be investigated, so the public trial was terminated. Bakırköy 3rd Commercial Court, which decided on the bankruptcy of Atlasjet Aviation Inc. in June 2021 and later overturned this decision by the Court of Appeals, decided on its bankruptcy again on January 19, 2023.
BANKRUPTCY CONFIRMED
The case regarding Atlasjet was then taken to the Court of Cassation. After the examinations carried out by the 6th Civil Chamber of the Court of Cassation, it was unanimously decided to confirm the bankruptcy decision and send a copy of it to the Istanbul Regional Court of Justice, 17th Civil Chamber, which is the court of first instance.
