Cem Gölbaşı, one of the tribune leaders of the Young Fenerbahçeliler, was sentenced to 6 years, 10 months, and 15 days in prison for allegedly holding B.İ., whom he claimed mocked him, captive, forcing him to wear a wig, and sharing videos of the incident on social media.

WHAT HAPPENED?

The incident occurred on November 4, 2024. Cem Gölbaşı, one of the tribune leaders of the Young Fenerbahçeliler, went to the workplace of B.İ., who was alleged to have mocked him by sharing a photo of him from a fake social media account. The suspects, including Cem Gölbaşı, İsmail Atan, Süleyman Şahin, Şahin Beyazyıldız, and Umut Özaydın, were arrested for the crimes of 'robbery', 'torture', 'disclosure of images and sounds related to private life', and 'depriving a person of their freedom by using coercion, threat, or deceit', while suspect Hasan Mert Şahin and Yunus Akbalık were released under judicial control. The trial related to the incident was held at the Bakırköy 22nd High Criminal Court.

"HE WANTED TO WEAR A WIG"

Defendant Cem Gölbaşı, in his defense, stated, "I reiterate my previous defenses; there are charges against me. For months, we have been subjected to organized attacks on social media, both myself and as GFB. They shared a photo of me in women's clothing, and the accounts that shared this have a lot of followers. There was a disagreement between the victim and a friend of his, and this person shared the victim's information. I asked my friend Şahin if he knew this person, and he said he was his neighbor. We were trying to investigate why they were doing this to us because these shares were not made from a single account but organized from dozens of accounts. When I went to the shop, his brother-in-law was also there. We entered the shop in a civilized manner, and I asked him if he had made the share. He initially denied it but later admitted and said he was sorry. He said he could delete the share if I wanted, and I asked him who made him do this, and he entered his phone password and gave it to me. We showed him tribune videos, etc., in the shop, and I asked him why he did this, and he said he made it trending on Twitter and later sold these accounts. He apologized to me, and I told him that it didn't matter to apologize, but you shared it by making me wear a wig and dress as a woman. He then said, 'Let me wear it too.' He had a wig brought from the shop and put it on his head; this is the only point where I succumbed to my desires. In fact, later, after about 20 minutes, I asked for the video to be deleted, saying it didn't suit us. I was victimized because of this incident; we stayed in prison for a ridiculous reason, and I request my acquittal," he said.

DECISION ANNOUNCED

The court panel announced its decision. The defendants Cem Gölbaşı, İsmail Altan, Süleyman Şahin, Şahin Beyazyıldız, and Ümit Özaydın were acquitted of the charge of 'torture', while they were sentenced to 4 years, 4 months, and 15 days in prison for the crime of 'robbery in the workplace with multiple people'. Additionally, Gölbaşı received a 1 year and 8 months prison sentence for the crime of 'depriving a person of their freedom', while the other defendants received 3 years and 4 months for the same crime. Gölbaşı was sentenced to 10 months for the crime of 'illegally obtaining or disseminating personal data', while Altan, Şahin, and Özaydın received 1 year and 8 months in prison. However, for defendant Şahin Beyazyıldız, a decision was made to defer the announcement of the verdict due to 'the absence of a previous conviction for intentional crime'. Additionally, a travel ban and judicial control decision were issued for the defendants.
