The 19-year and 6-month prison sentence given to the defendant, who ran over the person who had assaulted him with a gun after repeatedly shooting his brother-in-law in Kayseri, was overturned by the appellate court. The appellate court found the prison sentence excessive and sent the case back to the court for a retrial. The defendant will be retried in the heavy penal court.
On March 3, 2024, a chilling incident occurred on Gaffar Okkan Boulevard in the Mimarsinan Şirintepe neighborhood of the Melikgazi district in Kayseri. A dispute broke out between Y.K., who allegedly had a previous feud with his brother-in-law S.T. (45).
FIRST HE SHOT WITH A GUN, THEN RAN OVER WITH A VEHICLE During the argument, Y.K. fired at his brother-in-law, who was assaulting him, with the gun he had with him. The suspect then fled after running over S.T. with a vehicle. Following reports from bystanders, a large number of police and medical teams were dispatched to the scene.
DIED AT THE SCENE While police teams took extensive security measures in the area, it was determined by the medical teams that S.T. had lost his life. After the incident, Y.K., who fled, was quickly apprehended and taken into custody as a result of police efforts, while S.T.'s body was taken to the hospital morgue after examinations.
The deceased S.T. CHILLING MURDER CAUGHT ON CAMERA Meanwhile, security camera footage of the murder has emerged. The footage shows S.T. being confronted by his brother-in-law Y.K. as he exited a market, and being assaulted. It was captured on camera that Y.K. drew his gun and fired at his brother-in-law, and after running out of bullets, he changed the magazine and continued shooting. The moments when the suspect fled after running over S.T. with the vehicle were also recorded second by second by the security camera. Additionally, the panic of the surrounding citizens was also captured in the footage.
“I REGRET” HE SAID IN COURT On October 24, 2024, during the verdict hearing at the 2nd Heavy Penal Court, the defendant Y.K. and his lawyers were present. Defending himself in court, Y.K. stated that his brother-in-law had threatened him and that he had a gun with him for this reason. He mentioned that he lost control when his brother-in-law attacked him on the road and expressed his regret, requesting his release.
19 YEARS 6 MONTHS IMPRISONMENT SENTENCE As a result of the trial conducted by the court, Y.K. was sentenced to 18 years for "intentional killing under unjust provocation" and 1 year 6 months and 15 days for "possession and carrying of an unlicensed firearm," totaling 19 years 6 months and 15 days in prison.
THE APPEAL COURT FOUND THE SENTENCE EXCESSIVE As a result of Y.K.'s lawyer appealing the decision, the 1st Criminal Chamber of the Regional Court of Appeals reviewed the case and found the 18-year prison sentence for "intentional killing under unjust provocation" excessive, thus overturning the decision. In the appeal ruling, it was stated that due to the intensity of the unjust acts originating from the victim and spread over time, while a reduction in the defendant's sentence was made due to unjust provocation, a reasonable sentence should have been determined in accordance with Article 29/1 of the Turkish Penal Code, which foresees a prison sentence between 12 and 18 years, rather than being set as 18 years, leading to an excessive sentence.
WILL APPEAR BEFORE THE JUDGE AGAIN Y.K., who killed his brother-in-law, will be tried again at the 2nd Heavy Penal Court following the appeal court's decision to overturn the ruling.
